Hi Everyone!!! We received a Request for Evidence (RFE) last Dec 18,2011) concerning my fiancee's DUI's more than 20years ago. They (USCIS) asked him to provide them court dispositions on said DUI's. My fiancee and I has to go through the courts of which those DUI's were committed, glad that the said courts supervisor's were very accomodating enough to help us. We sent them (USCIS) all four of the DUI's court dispositions committed twenty plus years ago. And USCIS received them December 14,2011.

Now, for my questions and need badly your opinions on this. Will all the DUI's that were committed twenty plus years ago and my fiancee paid for all those, will this hurt our application? I really need your thoughts on this matter. We started our journey July 2011 got our NOA1. Thank you fellow VJer's and God bless us all.

The DUI's became an issue because there were 4 of them, the dates of the conviction does not matter. This is due to IMBRA laws which were enacted a few years ago to protect foreign fiances from potentially abusive USC men.

Typically DUI's are not an issue because it is not a crime of moral turptitude. Usually the Consulate makes the foreign fiance aware of the petitioner' past and gives her the opportuity to withdraw from the process.

Being that you ar familar with your fiance's past criminal history and that the offenses happened so long ago - chances are the petition will be approved by USCIS - it just may take some additional time to receive the NOA-2.

You will be asked about this at the interview, so be prepared and make sure there are not any other things in your fiance's past that could come back to haunt you.

GringoD: Regardless of your personal opinion of someone with 4 DUI's - this is NOT a crime of moral turpitude.

Excuse my spelling at 2:30am. And someday you may want to attempt to become tactful, but I doubt that will happen.

Any rehabilitation records and a doctor statement that he has remained sober will also be helpful. I have read about people getting approved with a lot worse offenses than 4 DUI's 20 years ago.

If it is Any Consulation to you, i have a friend whose Fiance received a RFE for the exact same thing (DUI). I cant tell you how many he had but he sent in the requested information, they wanted and to make a long Story short, she is is in Seattle Washington right now! Good Luck! Be positive!:thumbs:

Not that it matters, but I am confused. You say you received your RFE December 18th? That is today, which is Sunday. You also say they received you records back in response to the RFE the 14th, so in effect before the request arrived?

I can explain it to you. But I can't understand it for you.

I agree. I lost someone very close due to the actions of a drunk driver, but that is off topic.

OP asked if her fiance's 4 DUI's from 20 years ago would affect the petition - the answer is no. I-129F will be approved.
