Hi,

I am going to be travelling to my home country with my baby who will be a USC without my husband who is a USC too. I am on a CR1. Do I need my husband's authorization to leave the country with his child? Is there like an official paper to show? Of course, my husband knows and is OK but I just want to make sure that I am not gonna have trouble leaving the country, as if I was stealing his child.

He needs to write a detailed letter, basically saying the trip dates and that he knows you are going on a trip with the child and all that. Original signature of his and dated.

Can you cite your source? I've never heard of such a requirement.

Due to the increasing incidents of child abductions in disputed custody cases and as possible victims of child pornography, Customs and Border Protection (CBP) strongly recommends that unless the child is accompanied by both parents, the adult have a note from the child's other parent (or, in the case of a child traveling with grandparents, uncles or aunts, sisters or brothers, or friends, a note signed by both parents) stating "I acknowledge that my wife/husband/etc. is traveling out of the country with my son/daughter. He/She/They has/have my permission to do so."

CBP also suggests that this note be notarized.

While CBP may not ask to see this documentation, if we do ask, and you do not have it, you may be detained until the circumstances of the child traveling without both parents can be fully assessed. If there is no second parent with legal claims to the child (deceased, sole custody, etc.) any other relevant paperwork, such as a court decision, birth certificate naming only one parent, death certificate, etc., would be useful.

Adults traveling with children should also be aware that, while the U.S. does not require this documentation, many other countries do; failure to produce notarized permission letters and/or birth certificates could result in travelers being refused entry (Canada has very strict requirements in this regard).

Adults traveling with children should also be aware that, while the U.S. does not require this documentation, many other countries do; failure to produce notarized permission letters and/or birth certificates could result in travelers being refused entry (Canada has very strict requirements in this regard).

Brazil is one of those countries which has very strict laws in this regard. It is supposed to be entirely impossible for a child under 18 years to fly internationally from a Brazilian airport unless accompanied by both parents, or with a valid and notarized "Autorização de Viagem" from a non-accompanying parent. Supposed to be. I know for fact that my kids have traveled without my providing such a document. I suspect my Ex bribed an official to make that happen.

Travel Authorization for Minors

Autorização de Viagem para menor de 18 anos

The Travel Authorization for Minors permits minors accompanied by only one parent or legal guardian to exit Brazil. Minors residing abroad who travel to Brazil will need to obtain authorization that has been signed by the parent or legal guardian who will not travel with them in order to be able to leave Brazil. The signature must be legalized at a Brazilian Consular Authority before travel.

Each service request must be sent separately to the corresponding department of the Brazilian Consulate. Requests for the legalization of the Travel Authorization must be sent to the Legalization department.

The Travel Authorization can only be legalized upon presentation of the minor’s valid passport number. If the minor’s passport has expired, it must be renewed before the Travel Authorization can be legalized.

This is a very germane question because in order for a baby to get a passport the permission of both parents is required. My wife recently traveled with my son and although I wrote a letter it was not needed. I think that the passport has a lot to do with it. If a baby has a passport, both parents have already consented to the baby travelling, in general.

This is true, but all it means is that both parents consented at the time. A child's passport is not invalidated due to divorce, custody issues, or anything else. Most of these laws and practices are to avoid parental kidnapping. What is required to travel will vary from country to country - some countries require letters from the other parent, some don't - so it is best that anyone traveling with their child alone check the guidelines for the country they will be visiting.

Thank you very much for all your responses. I will definitely get a notarized letter. It really seems to be the way to go.

And sorry for not having updated my signature. Now it should be done.
