Hi,

We already send DS-230.NVC asks to fill up I864 form and related documents as a part of immigration process. She filled up all necessary information Except one thing.That is household size.

My wife stays with his brother,sister,father and mother.In tax resturn filled by her she has only one dependant(his brother). and her sister is co-spoancer to meet necessary income.

So how much count she should put into household size column in I864 form? kindly suggest me.

Sounds like you have a CR1 visa case, not K3. I can't follow the his and her clearly but are you saying your wife claims her own brother as her dependent?

I have a question about the I864, I am yet to get my NAO2 however I proactively completed my i864 and i864A forms last night. This is the story:

Tax of 2010 was for work period of August 2010 to Dec 2010 (New grad)

I claimed two of my siblings on my taxes for 2010

This put me 500 dollars short of the 125% of the poverty guide line for a 4 people household (Myself, husband and two siblings)

However my projected earnings so far for 2011 will put me above the poverty guidelines for 4, especially if I present my pay stubs.

To be on the say sides I called my mom for back up (so 500dollars doesn't delay or hinder the process)

My mother then files the 1864A for me and both our earnings for 2010 is way above the requirement.

My question:

Do I really need to use my mom as a joint sponsor esp. if I can prove that I earn way more than is required for 2011 (without filing the 2011 taxes)

In 2010 my mother sponsored both my siblings I130 and I864 and I turned around and claimed them in my taxes of 2010 cause I helped them settle in financially.

I am trying to prevent a messy situation that could result in delays and RFEs'

Sounds like you have a CR1 visa case, not K3. I can't follow the his and her clearly but are you saying your wife claims her own brother as her dependent?

If they are not dependent on her. Then the house hold size is just she and you in her I-864.

If her sister is co-sponsoring, then her sisters dependents plus you will be her sister's household.

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

If your wife included her brother in her tax return and still dependent on her then her household size will be 3 = (Wife, wife's brother and You.) Now, the question is where to put the one in Part 5. Sponsor's household size #21e or #21g ??

09/06/07: Went to the Philippines to marry my fiancee.

11/29/07: Wedding Day!

11/30/10: Going back to US, to get my wife!

05-06/11: Sent & Received Congressman's letter & advice.

06/23/11: Found and joined... VisaJourney.com!

06/27/11: Filing “Form I-130 IR-1” and Expediting it with Humanitarian cover letter.

07/08/11: Mailed I-130 to P.O. Box 804525, Attn. EXPEDITE I-130 SPOUSE, Chicago, IL.

07/18/11: Received Hardcopy Form I-797C or NOA1 in mail, receipt date 7/13/11 and priority date 7/12/11.

08/08/11: Called USCIS 800 number to check on status.

08/23/11: Request for Expedite Approved. Received NOA2 dated 08/23/11.

09/09/11: Called NVC they got my file from USCIS.

09/13/11: Received NVC Case# & IIN# (via email) & emailed DS-3032 from PI to NVC.

09/14/11: AOS Fee Paid Online (status PAID on 9/15 also at this time IV Fee Bill Generated)

09/16/11: IV Fee Bill Paid Online (status PAID on 9/19 and printed Barcoded Coversheets)

09/20/11: Express mail both the I-864s AOS and IV DS-230 (arrived 9/21 NVC)

09/27/11: Case completed file shipped to USEManila; arrived 10/3

10/13/11: Medical passed/completed today but still NO interview date yet?

10/16/11: Called USEManila file ready! Called Appt. Services set up Interview Date for 11/9/11.

11/09/11: Interview. But had to comply with 221g, re-verification forms CENOMAR/NBI.

12/02/11: Visa approved but delivered 12/7/11.

12/12/11: POE – Detroit.

Hello sir,

Actually they(mother in law & father in law) are not dependent on her as because my mother in law is doing job but all people stay under same roof. so i have confusion whether i have to count total people in household size or just ( me, my wife,my sister in law and her dependents).

Kindly suggest me.
