Hello all,

its been 47 days since my fiance failed her interview at the embassy (reason 221g.. didn't believed the relation to be real...etc...).

To date, i've sent emails to embassy, notarized mail (DHL very expensive) and of course they gave me the standard respond via email.

I have not heard anything from USCIS.. Our NOA2 expired on 9/22/2011. Sould i just go ahead and make request for cancel? i have heard nothing form USCIS.

I intend on filing a CR1 because if i re-file a K1, the US embassy CO will ask; you've waited this long, why didn't you just get married? and of course another 221g,

Yes, I know CR1 is not %100 proof. but its better then 0%.

And oh yes, my fiance asked the local government office, they said I needed some type of "police certificate". never heard of that here in the US, other than a backgound check.

thanks for reading this.

I am so sorry to hear that. I'm really mad to seeing many people can get their visa approved and turned out that it's only for green card or sham marriage. I read a lot here, after married, some people whether benefiary or petitioner changed their behaviour. The genuine relationships get blame for it. I can't help you, but just to give you my thought about how unfair make these things happened..crying.gif

My two cents is this, go ahead with your plans to marry and then file a spousal visa petition. In the meantime, keep tabs on this current petition to see just what the outcome will be (especially if USCIS decides to issue a Notice of Intent to Revoke {NOIR}).

There is a high degree of probability that USCIS will simply let the petition expire and that will be it. However, if they decide to issue a NOIR, then that notice must be responded to and it must be responded to by the deadline that is on the notice.
