Forfeiting LPR status won't guarantee you a nonimmigrant visa

Q: I used to be a legal permanent resident in the United States, but I moved back to Forgein country approximately five years ago after I retired. Can I apply for a nonimmigrant visa to go visit my sister in the US?

A: An individual who is a US citizen or a US legal permanent resident may not be issued a nonimmigrant visa. During your nonimmigrant visa interview, the consular officer will ask to see proof that you no longer possess legal permanent resident status.

Giving up your legal permanent resident status does not guarantee that you will qualify to receive a nonimmigrant visa. You must demonstrate that you meet all of the legal requirements to obtain a nonimmigrant visa. During your interview, a consular officer will ask questions to determine whether you reestablished strong ties to country of orgin after moving back from the United States.

If you have not formally abandoned your legal permanent resident status, you must complete the necessary paperwork before your nonimmigrant visa interview. This documentation may be completed during USCIS office hours at the Embassy.

The US Embassy will answer questions you may have regarding the US Mission, including consular law, regulations and/or practice. In order to respect privacy, staff will not answer questions about specific visa applications.

The post was informational. Good information. I asked my father if heb would give up his grren card to avoid it being revoked but he declined.

As far as I know, it's not even guaranteed that the sun will rise tomorrow or that President Obama is not an illegal alien from outer space with a reptile body under the human one.

Personally, the only thing guarantee that I know of is that, there are those on VJ that always have to have the last say in concept, if the information didn't originate from them.

AS, on VJ mod is famous for saying, if what you have to contribute isn't postive, then say nothing at all.
