Timeline

I was wondering about how long it's taking for AOS to be approved? Can they deny an AOS? If so, what are the reasons? Also how long for EAD? We are still waiting to be touched again.

Husband's already had his biometrics appointment and we were last touched Sep. 9th. I know that's only a few weeks ago, but he wants to start looking for a job. Also I kinda need an estimate as to how long til the GC comes because I am planning on goin back to school in the spring, but I know when his GC gets here we will be taking off to Morocco for a month, therefore I need to plan my classes around the GC coming and the Morocco trip.

So if anyone has any information to offer we would grately appreciate it!

It varies different local CIS offices take different lengths of time. Take a look at the timelines "Post Visa Display Options" select AOS or EAD and filter for the local office that you will use Chicago. Excuse you! :huh: My Timeline is filled in! I was told that Philadelphia is my local office even if I am sending it to Chicago. If you read my timeline, which obviously you didn't, it explains that I didn't file for a K-1 or a K-3 just AOS and the I-130 because he was here on an F-1! I haven't found anyone with a timeline even close to ours, so if you happen to find one, let me know thanks! :D

OP, You would still check the same way as outlined above, from the drop down menus at the bottom select Philadelpia instead of Chicago. It will give you a rough idea of your wait time.

It's nearly impossible to predict, Janine. Look at our timeline in my siggy. One can be granted the interview and still not have the greencard for months, maybe longer.

If he wants to travel, maybe you should file for AP. Then it won't matter when the card arrives.

By checking the timelines it looks like the Philly office takes between 4-10 months from the filing date to interview.

OK I looked at the USCIS site:

Philadelphia is processing I-485 (AOS) cases dated March-14, and I-765 (EAD) cases dated June-27

According to Philadelphia USCIS page:

Adjustment of Status:

Please see the instructions on Form I-485, Application to Register Permanent Residence or to Adjust Status, to determine where to file your application.

For those adjustment applications filed at the local office, please note effective February 17, 2004, the Philadelphia District Office will no longer process I-130/I-485 applications or any application submitted in conjunction with an I-485. This includes Form I-765, Application for Employment Authorization, and Form I-131, Application for Travel Document. We will accept the applications by mail or in person, with fees attached and forward them daily to the National Benefit Center for processing. You will receive a filing receipt from that office within 14 days. All employment documents and travel documents will be mailed directly to you from the National Benefit Center. Adjustment of Status interviews will still be conducted locally once the case is scheduled and transferred back to Philadelphia.

Yes, they can and do deny AOS. What would be the purpose of an AOS interview if they couldn't deny it?

Reasons:

Insufficient evidence of a bonafide continuing relationship.

Insufficient financial support.

Crimes committed.

Read the Yes/No questions on the I-485. If you have the wrong answer to one of those questions.

If they discover misrepresentations in the application.

If unfavorable information comes back from the security checks.

I130 when filled concurrently with I485 are adjudicated on the same date. When you go to the interview, both forms will be reviewed and checked. In our case, AO started with I130 and then transitioned to I485.

As regarding timelines for Philly - one couple just before you got interview 5 months after filing.
