Can i send my daughters C130 after my case is closed

Hi VJ's

My case is almost closed, just sending of the final document with originals this week. I want to apply for my 18 year old daughter to come. She has been chopping and changing her mind about coming to the US so i decided to just apply anyway, and as well financially i couldnt do our petitions together. My question is: If my case has been closed and sent for interview is there a time window of applying for your children on a CR1, can i link her to my petition?,If she is linked to my visa woule hers go through any faster? She was under 16 when my partner and i got married.

I cant believe we got this far.... Its been a longggggggggggg road :)

no, stepchildren are filed separatly, if you were married before she turned 18, your husband can file an i130 for her and go through the same process you are going through, going through consular processing.

You are applying for an immigration visa as an Immediate Relative of a US citizen spouse. (Immediate Relative means a spouse, unmarried child under 21, or parent of a US citizen). Derivative beneficiaries are not allowed when petitioning for an Immediate Relative. Your daughter cannot be added or linked to your case.

Your US citizen spouse can petition for your daughter as an Immediate Relative because she was under 18 when your marriage occurred. She qualifies as his step-child. Your US citizen spouse will need to file a separate I-130. Your daughter will go through the same process you are going through.
