While I'm confident this question has been answered a number of times, I'd appreciate the help.

Background:

Last week I (petitioner) submitted the I-129F, and its supporting documents. My fiance has obviously not been contacted yet by the US Consulate in Australia.

Question:

Upon coming to the United States on a K-1 Visa, getting married, and filing an Adjustment of Status, is my then wife able to travel back to her country to handle affairs? If so, how long would she have to wait before doing so, or what documentation would she be required to have?

Request:

Please outline or provide a link on the adjustment of status process / timeline, or a quick yes/no.

Your fiancee will have 6 months to use her visa, which should be enough time to wind up her life abroad. It will take about three months, but can take longer, for her to be able to travel after she filed for AOS after marriage.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

SGT Beatty your AUssie wife will not be able to travel until she receives and AP advance parole/ ead card which usually is received before the green card. As Penguin has stated she has 6 months to use her K1 visa and should be able to tie up all the loose ends back home before she flies to you. If she can't do that then once she arrives here on K1 visa , you marry within 90 days and then good to file AOS (residency GC) ASAP. This timeline is not regular but can take 3-6 months. I applied for my GC October 2010 and got GC beginning of March 2011. Hope this helps

This is good advice, Let her come over and get married in peace not having to worry about going back in a rush. If this option is possible I say go for it mate.

A word of caution about AP...

Many K1's are scheduled for an interview at a local USCIS office when they adjust status. The interview letter often comes soon after the EAD/AP are received. If the alien leaves the US with their AP and then gets scheduled for an interview then they need to be prepared to return in time for the interview. If they miss the interview then the AOS will be denied and the AP will be revoked, leaving them stuck outside the US without permission to reenter.

If your wife uses the AP then make sure her plans are flexible, and that she can return to the US on relatively short notice if needed.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
