So I'm about to send my AOS package. Thank to all VJ members, I've learned so much about the process. I learned about the 864EZ which I was about to send in but noticed that everybody says that you can't submit the EZ form through self employment. Well I'm not self employed now but I did have my 1099s from back in 2008. Officers will see a loss of -$3K in my tax transcript from 2008 and that was my only source of income back then. My 2010 tax return is above the poverty guidelines with the W2s. I just don't know what the consequences will be with the 1099s from 3 years ago. Should I just not bother and send the regular I-864?

You can send I-864EZ if you are using just wages and are supporting just your spouse.

I used I-864 eventhough I used just wages and sponsored just my wife (just leave the Part 7 blank), as it is safer.

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

You have to send in W-2s if you do a I-864EZ. I choose to do I-864EZ. I don't see why not. Using I-864EZ demonstrate your confidence that your financial condition meets the requirement pretty well and you want to use the simpler form. So I see no harm using it. The NVC already says they looked at my AOS package and see no problem at all.

My USC husband and I did the same thing - sent I864-EZ along with his W2s, single 1099, copy of 1040 for the last 3 tax years AND a letter from his employer stating 1. date he started with them, 2. what his role in the company is and 3. what his salary is for 2011.

It might have been information overkill but I would rather send them too much information then not enough. It was accepted by the agent. :)

I-864 or I-864EZ, it is still either IRS Tax Transcripts or a copy of the full tax return filed (includes W-2s, 1040 and other forms filed).

We did the I-864EZ with tax transcripts and had no issues. As of last friday, our AOS paperwork has been reviewed and found to be complete.

You can choose to submit only your most recent year's tax papers. Sending tax transcripts/returns for 2009 and 2008 are optional as per the instructions on the I-864 and I864EZ.

USCIS: CR-1 Visa @ Vermont Service Center (Approved in 140 days from NOA1)

03/07/11: I-130 package sent to Chicago Lockbox

03/14/11: NOA1 via text and email (03/21/11: in the mail); petition routed to VSC

07/27/11: NOA2 via text and email (07/30/11: received in the mail)

08/01/11: Case received at NVC

09/19/11: Case complete and forwarded to consulate

if we have a message on AVR stating and asking to send the IV package though we've already sent it out, does it means that we get an false RFE? i got this sort of message for my case but i don't know why they sent us a checklist on my son's AOS packages?

Yes, it is false RFE. Once they review your IV packet, the message will change.
