Withdrawing application - Help!

Hello there:

Bad news (for me)...my wife and I are separating and I will spare you the details (too many).

Our status with the process was:

I 130 Approved.

Filed AOS and all the other steps before

NVC, I was filling the DS 260 (final form) .

I called USCIS and they said I need to send a letter to "cancel/withdraw" the I 130

NVC told me to email them which I did then I have received an email where they requested a signed letter instead.

- can you please share your experience on this subject?

- is there any sample letters available here for this matter...I just can't think or draft it by myself these days because of the stress this has generated. as this whole thing is awful and I wouldn't want anyone to go through it.

Wow I am super sorry to hear this, This process of Waiting is already to long and now this, I don't know if there's an example of such letter but I can only say just write a sample letter with your name case number her name and reason for writing i.e. WITHDRAW of APP and sign it then send it back. make sure to really think about withdraw because if you guys "make up" it'll be another long pain and this withdraw will come up too. Good luck.

12/13/2011 - Interview done APPROVED!!!!

12/21/2011 - Entry to US JFK!!!!

Don't withdraw! Just wait for it to auto-expire. I think it takes about 1 year. What if you guys change your mind?

If NVC doesn't hear from you in 1 year your petition will expire. People do get back together. Give it sometime before you do anything about your petition.

The above statements about the petition expiring are incorrect, approved spousal visa petitions never expire. If there is no response to the NVC within one year, then the process of termination would begin. NVC would send it back to USCIS and the USCIS would have to officially revoke the approval. If the OP wants to withdraw the petition, then it must be done formally.
