hello vjers! me and my fiance were really dont know if we are going to file a K1 visa. My fiance doesn't work in his country because he has a disability pension from his government and this is gonna be a big problem to pass the petition.

Please somebody help us what we gonna do...

These are the poverty guidelines he will need to meet: http://www.uscis.gov/files/form/i-864p.pdf

If he has no dependents, then he will need the 125% level for 2 which is: $18,387. If he doesn't make enough with his pension and any assets he may have, then he will need to find a co-sponsor.

I hopr your I-134 will be fine too. Keep in mind that the U.S. Embassy Manila accepts cosponsors on a case-by-case basis. There are no guarantees that they will accept your fiancé's cosponsor. Good luck.

i have question too about this..what if he has a dependent but is not living with him and just sending child support? which bracket of the poverty line will we use to calculate if his income is still in the 125% above poverty level and need not a co-sponsor?

If his income is solely government disability pension then you will need to look at getting a co-sponsor. If he has income in addition to the disability pension that meets the requirements then you are good to go. One person got all the way to Guangzhou and because he is on government disability his petition was blue slipped for a co-sponsor. The VO's "logic" was that he is already a government charge so his wife would be also. BS, but the VO's have the last say. For a K-1 visa it is a bit more lax as the support issue really comes in to play at the AOS stage. But be prepared for this and plan accordingly and you will be fine.

Any dependent children under 21, no matter where they live, are counted in the household.

It's my understanding that any unmarried children under 21 are counted as part of his household. So, if he has one child, then his household size would be three...him...you...and his child.
