125% above poverty line??

Hi guys,

I was wondering if I need a joint sponsor.

My 2008 & 2009 tax reruns were below $12,000 due to me being in college full time and working a part time job. I graduated from a university in 2009 and got a successful fulltime job afterwards. My 2010 tax return is about $40,000 but this year annual income is now $68,000 ... Can I sponsor my FIANCE?

The poverty line in HAWAII is $21,162. I'm not sure how this 125% works.

They do need your three years of tax transcripts but from what I've seen ..they look at the past years but consider the last one the most important of previous earnings... 2010 so your way above in 2010 and in this current year they also look at closely so your way above in 2011 so you are fine....

so in other words considering yoru above poverty in 2010 and the current year.....no need for joint sponsor...

They do need your three years of tax transcripts but from what I've seen ..they look at the past years but consider the last one the most important of previous earnings... 2010 so your way above in 2010 and in this current year they also look at closely so your way above in 2011 so you are fine....

so in other words considering yoru above poverty in 2010 and the current year.....no need for joint sponsor...

Thank you for your quick reply... I was worried about my 2008 & 2009 tax returns and I had no idea what it meant for 125% above poverty line. Anyway I'm still waiting on my case number from NVC.

what you looked at for 125% above poverty for hawaii is correct .... you must make at least that amount per year to sponsor 1 person... each person you sponsor goes up in the amount necessary per year of income. They really like you to be over and you are well over that amount.

May want to just include a simple letter regarding your 2008 and 2009 just saying you were in school etc. But like I said they like to see you regularly pay taxes and then they really look at the last year tax return for income and the current year to be sure you are stable in paying taxes and making income and have appropriate income for the number of beneficiaries.

You should be fine :)

If you Google "125% of poverty line" you should be able to find a site that will tell you what 125% of the poverty line is in Hawaii, but if not, all it means is that you need to make 25% more than the poverty line figure you gave - so $21, 162 + an additional 25% of that.

I did not do a K-1, so I can't tell you how much they'll care about your past tax returns (we did AOS, and I didn't even have a copy of the last three years, I only sent the last year and that was no problem), but they DO understand that circumstances change. You can also send along a letter from your employer stating your job and current income, so they know that the higher figure is accurate. I highly doubt you will have a problem.

I picked up my employer letter and I will make a letter stating that I been in school during those tax return years. I also have several recent pay stubs and recent checking and saving account bank statements. I just need my bank letters which I'll try to obtain.

Nothing on any affidavit of support asks for current year income. K1 applications do not use a "joint sponsor". That's a term that applies to the I-864, not the I-134 used in the K1 process.

The OP's current income qualifies them. They do NOT need three years of tax transcripts or copies of three tax returns. It's OK to provide them if it will help but no need if it won't. If I were the OP, I would state the current income and document it with a current pay stub, then also provide the 2010 tax return. No need for 2009 or 2008.

To clarify, current year income and current income are not the same thing.

Pushbrk is right, previous years are OPTIONAL the most recent tax year is required. For this year it would be the 2010 filing. You do have to be current with no outstanding tax any previous years but they will know that. Also check the poverty guideline page carefully because they might mean for you to multiply the povertyline shown by 1.25 to arrive at the amount you need to be above. Some charts are alreday muliplied some are not if not it should say so in the fine print. It doesn't matter for yours as your way above but just putting it here anyway. Jim.

How come the I-134 form ask for annual income... Isn't it the same as adjusted gross?

Congradulations, I've done the math for you and you are currently eligible to sponsor 2 fiances at the same time. Unfortunately the group discounts have been discontinued.:o

You do NOT have to be current on your taxes. A tax lien would be a problem but it takes years of past due to get to that point. Good clarification on the percentage though. It's 125% "of" not 125% "above" the poverty level.

This is incorrect as well. It's line 22 in most cases from a 1040 form which IS "total income". AGI is only used if using a 1040EZ to file taxes. HOWEVER, the figure from the last tax return never goes on an I-134 unless the sponsor is self-employed. You've got a lot of things confused. May I suggest you read more on this subject and learn about it before posting more misinformation? Please?
