Hi....We are doing our paperwork for AOS. On the for I-485 In the first section "Information about you" The very last box in that section asks for an expiry date. I am unsure if they are asking for the I-94 expiry or the Visa expiry date. Can someone advise please :-)

I went today to get my vaccinations transcribed to the I-693 so we are all set to send the paperwork possibly tomorrow :blink:

They are asking for the expiry date written on the I-94. The visa expiry date became completely irrelevant the instant the visa was used to enter the US.

I put the I-94 expiration date.

ROC

01 May 2013 - Received ROC reminder letter

22 Jul 2013 - Mailed I-751 via USPS Priority Mail

24 Jul 2013 - NOA1 date

27 Jul 2013 - Received NOA1

03 Aug 2013 - Received Biometrics letter

20 Aug 2013 - Biometrics appointment

19 Sep 2013 - Approved

24 Sep 2013 - Received NOA2

09 Oct 2013 - Received GC

The "Expires On" field on the I-485 is surrounded by fields asking for the I-94 number and your current status (which for you, Jeannie, is "K-1 Visa Holder" per the sample form on this site, which, BTW, you should double check your forms against before sending them off). The expiration date they are interested in is clearly implied to be the expiration of your current status, which is the expiration date written on your I-94.

COP: that is utterly bizarre that your I-94 had no expiry date. Probably the only reason you got away with putting the visa expiry date on the I-485 was because the adjudicator looked at the photocopy of the I-94 you included and saw what a pig's breakfast the PoE officer made of it. [The PoE screwing up an I-94 is far from unheard of. At my PoE, I almost got a multiple entry I-94 before the guy noticed and called over a senior officer to show him how to do it properly.]

To Jeannie and everyone else, that field on the I-485 is for the I-94 expiry date. COP's situation is/was very atypical.

There is a provision listed in the Employer's Handbook. It does state that if the I-94 does not show an expiration date, the I-94 is valid for one year. They are not going to reject your application for putting a wrong entry in that field for a K-1 filer.

Thank you so much for the speedy responses :-) .....My I-94 has an expiration date of August 18th which was the 90 days from my date that I entered.

That form is ready to print!

COP: Interesting. That being the case, the PoE + one year date would be the correct date to put in the "Expires on" field of the I-485, I would think.

Was your (or your significant other's) PoE with a K-1 visa? Or something else entirely? K-1 visa I-94's are supposed to have an expiry date of 90 days after PoE, and even if there is a fallback/default date in the law, it still seems like a big error by the PoE if they don't put an expiry date on the I-94.

September 2007 at San Francisco. She was the last one processed on that flight from the Philippines as a K-1.

You can use the i94 exp date, I think you are eight in the 90 day window or not, only you know. at mailing.
