Ok. So my fiance' in his confusion , confused me.

They did not take his I-94 from him, because he never filled one out.

All he filled out was the Customs declaration form, and that was what was taken from him.

He went through the visitors line, they asked him a few questions, took him into a room and processed him and kept the K-1 package.

The entry Stamp is stamped directly on one of the pages in his passport.

I cannot understand how he went through all this and no one mentioned he needed to have the I-94 filled out. That said, its not his fault. He wouldn’t know as he’s never travelled. I don’t have $330 to pay for their mistake. I called CBP, and the man was not the kindest, and told us that they don’t staple I-94s into passports, they stick them in there and make sure it stays in. *gasface* Whatever.

Can we just go to BWI airport and state our case and see if we can get an I-94?

I will. I just feel so discouraged by the Immigration Officer I spoke to on the phone. He was quick to point out that my story changed. He thinks my fiance simply lost it. I asked if we could come up there and he said it doesn't matter if I do because they will tell us the same thing at the window that he is saying now.

also, i think they make a point of NOT stapling it in the passport so that there's no proof if someone lost it. they can just stick to their line of thinking that the person just wasn't careful and let it slip out of their passport.

A lot of the times the guys there are not very nice! just smile and keep being nice to them it makes them more frustrated hahaha. =)

Mine was stapled in when I crossed from Canada, not sure about other places but considering that you payed for the I-94 when you bought your plane tickets I think that guy is making an excuse to cover his or someone elses butt that forgot to give the I-94.

Google also CBP deferred inspection office in your location and show up there.

Edited to add: I had 2-3 US tourist visas and 1 J-1 visa and in each and every case had a I-94 STAPLED in my passport - no idea what they're talking about no longer stapling them (cost-cutting measures?).

The big "do not open" envelope is supposed to be taken at entrance yes. They give you the I-94 in return. SHOULD have been stabled to the page beside the Visa in the passport.

That is not true, I-94 is stapled most of the time to your passport. There would only be few agents who do not staple the I-94.

They should have it on their record if they ever issued her one or not. So even if your fiancée has lost it they should have the other part of I-94 to prove that they issued one.

If they have the other part of I-94 then it was issued to fiancée and (s)he dropped it or something and you might have to pay the replacement cost.
