Timeline

hi ,

We got married and i left the states back home to take care of my dad's health ( we eventually lost him ) only to discover we should have waited to receive advanced parole. We wish we discovered this forum earlier.

What can we do now since its apparent i won't be admitted back even if i tried & how long will that take.

We appreciate the help

Thanks so much even though this is really sad...anyways, it was for a good cause. I would rather wait 2yrs than forgo the opportunity to see my dad for the last time. I still have a valid Canadian visa though and i guess if the wait becomes unbearable we can meet in Canada.

Make sure to follow the guides and put together a good petition because even though you were approved once that is no free pass for the second visa

Timeline

Depending on the timeline involved, they MAY grant you emergency advanced parole. Your fiancee should make an infopass appointment with a copy of your father's death certificate. I've heard of cases where people have received advanced parole after leaving the country. There are no guarantees, but it doesn't hurt to ask.

Did you file AOS before you left ? How long after you married did you leave and how long after you arrive did you get married ? How long have you been gone ?

CLARIFICATION:

Advance Parole MAY be granted to certain non-immigrant visa holders while they are outside the US if they left in emergency situations. However, those who entered the US with a K-1 visa are not eligible. This is explained in a meeting between USCIS and the American Immigration Lawyers Association in April, 2008.

"Advance parole granted to those outside the U.S. is an extraordinary measure used sparingly to bring an otherwise inadmissible alien to the U.S. for a temporary period due to a compelling emergency or significant public benefit. It is not to be used to circumvent the normal visa issuance process. Advance parole that is sought to preserve the pendency of an I-485 application must be applied for and granted before the alien’s departure from the U.S."

Sorry. It seems the only option is to start with a new visa/aos process.
