I need some advice Please! 15 days ago we received the NOA2 notification but its been 3 months already that there is no communication between my boyfriend and I. Just random text messages along the week. We have been going through a lot of issues and although we have tried to work things out but in my opinion instead of progressing and growing our relationship it has been the oposite. We dont even talk!! i have asked him to cancel the petition but he refusses but honestly i dont want to marry someone that doesnt even talk to me..at all!

I have been reading that it is only the petitioner who can cancell the petition, but what should i do if he refusses to do it??

Im the beneficiary, im from mexico and i have give to much thinking to this and i already took my decision. I no longer want to marry him. I told him so and he just ignored me.

Please i need to know if there is anything i can do on my side to withdrawn the application. I have a turist visa and i would like to keep using it once on a while visiting my friends.

I have read that i can write a letter, but is this the case if im the beneficiary??? if so, what is the letter like?? can you please give me some examples?? Iam deseperate...

Please help!!

You could just let it expire...

There is a difference between the 129F petetition application (done by petitioner) and the application for the visa itself (done by the beneficiary). It looks like from your post that you have not even applied for the visa yet. So there is really no application made to withdraw, all you have is just an approved petition. Agree with the above poster. Having said that, it is always sad to see a couple in disagreement. Best wished to you both.

You can't cancel the petition, but you don't need to. Just don't apply for the visa. The petition will expire on it's own. :thumbs:

just dont apply to for the visa and dont go to an interview. Those two things are the only things that will allow you to go to USA on I-129f petition. U dont have to worry.

I know it's a long time since there was a post on this topic, but just in case anyone else sees this topic while looking for similar advice....

Based on my recent experience the advice given above is not accurate. An expired petition can still be in the system (about 8 years later my fiancee's ex's petition was still in the system) and cause subsequent petitions to be sent back from the embassy to USCIS. If you're with USCIS-CIS this will cause you a denial 'cos they will let your newer petition expire instead of reviewing it.

Try to get the petition withdrawn.

You could write a letter almost the opposite of the Intent to marry letter. Let USCIS that you no longer want to marry and to cancel the petition. Not sure if the beneficary can do this, but they should send denial letter and the case might get withdrawn. Good Luck

Maybe you could try to contact your embassy saying you're no longer interested in getting married and that you won't show up for the medical and interview. Instead of not doing anything, maybe it would be better if you let them know about it... hopefully someone else can give you better advice though.

I suggest get a copy of the nvc letter address to your fiance so u will have a copy of the approved I-129f petition and keep it for your own records preferably the letter with ur case number...this way you will have a reference when u will meet someone who will petition you in the future...it better to know your cae number...just a suggestion.
