I sent my I-130 on February 2 and on February 7 it was received by USCIS. And on February 14 I received the I-797 Notice of Acceptance 1 (NOA1). Since I live in New York, my case is with the Vermont Center. It was been five and a half months and I have not received anything regarding my case. I called USCIS and they told me it is still in the Initial Review, and when I asked what date are they up to in their cases load, he said May 15. I have no idea what's going on. Any ideas, suggestions, or similar stories.

Calling USCIS is pretty much a waste of time, I think. It says that 5 months is the average wait on the site but I think 6 months is really how long it takes for a petition to be approved. So you might have a wait a few more weeks.

Have you contacted senators/congressmen? That might be a good idea.

When you called USCIS did you ask to speak with a tier 2 rep? That's what I did and found out they had sent me an RFE. If I wouldn't have called I would have never known as the 1st RFE was lost in the mail. They had to resend it.

9/9/11- Paid AOS fee of $88.00

10/11/11 - NVC Received AOS package

10/14/11 - NVC approved I-864 AOS package

9/13/11 - IV bill received

10/29/11 - IV bill fee paid

12/01/11 - IV packet mailed

12/14/11 - Case complete!!

01/31/12 - Medical Exam

02/07/12 - Interview-Approved!!

It was my first time calling them after getting tired checking the webiste for any updates to my case. The person did not state what tier he is. I did not ask since I am not aware that they have reps with different tiers. I will call again in a week and follow your suggestion.

Request for Evidence

Call the 800# for USCIS and let them tell you the status of your case. After that ask to speak with a tier 2 rep. The tier 2 rep has more info on your case then the general rep whom answers the call first. They only have access to what you do on the USCIS website.

Similar story here...

I also live in NY and applied for my husband, form I-130 through Vermont Service Center. I am USC.

I applied in September 2010, and after 10 months, still waiting for NOA2.

No exact annswer as to why its taking so long, but I'm pretty sure its because we are Yemenis.

If you read my other post, you can see that I-130 petitions require the petitioner to go through an interview if the relative is from Yemen.

I guess Yemen is a high fraud country.

Yemen is also known as a 'terrorist country' That can be another reason.

And the political situation in Yemen is not helping either.

As-salamu Alikum Sister,

I am not sure if you are aware of the face that the US Embassy in Sana’s is “suspended until further notice” due to the political unrest and chaos that is currently going on in Yemen. So even if the USCIS approves our petitions, a further delay is inevitable.

As far as the interview process, it is a common practice that has been in place for years. That is why they require Marriage Certificate to be notarized by the Ministry of Justice, and Birth Certificate by the Ministry of Internal Affairs.

However, in cases of spouses, they are not strict since they are aware that marriage, especially in Yemen, is religiously and traditionally sacred and it is not something that can be easily faked or tampered with.

have you called USCIS, asked for case status, or spoken to a Tier 2 operator ?

Maybe best to visit one of the Monthly I-130 filing topics here at VJ, as well, read all, get some sense of approval timings, actions, etc, from the rest of the folk that filed in yer month.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
