Actually I just read about it , and it seems like the only criminal record that can affect/prevent an i-130 petitioner for filling for a spouse is when it falls withing the Adam Walsh law . which is sex offenders.

It will not directly affect, meaning it will not be the reason for denial. However, these charges will be red flags - basically, they will suspect her of visa fraud (money for visa) and will likely scrutinize your application more looking for signs of the fraud. This will not be direct.

If the petitioner's criminal past makes them suspect of their motives in the marriage and filing for immigration, it can affect the outcome. It does not disqualify them outright.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

This is right. And if denied they will not deny because of the record but because of the suspected visa fraud.
