Dont know where to put this topic but it looks like it fit in this forum. I'm (US citizen) getting married in Sept to my fiance (foreign nationality) in the philippines. My question is which route should I take to petition her so that we can be together here in the United States as soon as possible. Should I apply for a fiance visa I-129F then after marriage refile it as I-130 since we change our status then apply for a K3? Just want to be with her ASAP. thanks for any information that you guys will provide.

You don't change the status of a petition and they don't give refunds!

You have to pick one either the K-1 and apply and wait to get married until she is in the USA

or you marry and apply for the CR-1 after marriage.

The K-3 is expensive and not a good choice as they are usually closed at the NVC.

There is no ASAP in this process you will be waiting either way.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I am a Citizen of the United States of America. 04/16/13

If you are fully intent on getting married in September, then get married and file for the spousal visa

K3 was not active anymore so even if you go via K3 route you will end up in CR1 process.

If you are marrying outside the US and then applying for your spouse the only route you have is CR1.

If the I-129F is filed in conjunction with the I-130. It will be tied together by the USCIS and both petitions are typically approved at the same time. Recently the I-129F filed in conjunction with the I-130 has been making its way to the NVC first. In such a scenario, the K3 goes forward and all the NVC will do with a K3 is assign a case number and send it to the Embassy. If the two petitions arrive at the NVC at the same time or if the I-130 arrives at the NVC ahead of the I-129F, the K3 process will be administratively closed.
