That may very well be true...and I understand this makes more sense than the 100% rule since you do your AOS soon afetr marriage but, if you go to this link http://travel.state.gov/visa/immigrants/types/types_2994.html#9 you will see what the GOV says:

"Do the Same Income Requirements Apply to Form I-134 as Apply to Form I-864"?

No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.

Maybe each USEM is different...I'm not sure abut Manila...but not a concern for me.

My question reamins though....were is the money coming from for this journey...maybe that person could co-sponsor

Those are the general Department of State policies for a non-immigrant visa. Many (most?) consulates treat a K1 differently than other non-immigrant visas because it's one of the few that is almost guaranteed to end with the visa applicant immigrating to the US. Because the I-134 is not submitted to comply with INA 213 (like the I-864) Department of State and consulates are free to establish their own standards. Few consulates would be willing to issue a K1 visa to someone whose sponsor(s) will not be able to submit a sufficient I-864 affidavit of support when it comes time for the K1 to apply for a green card.

05/01/2013 - Removal of Conditions - APPROVED!

I highly doubt Scott wrote this reply. I don't think you Understand anything your talking about and Philipphine Guildlines.

Lady...you certainly don't know what you're saying nor who you're talking to. This is Scott, and I did post that message. It was in response to someone saying that the embassy required 125%. Their embassy was in China. That is why I responded that I do not know about the Manila embassy requirement to meet 125%, because I have not seen that anywhere in their instructions. The quote "not a concern for me" is because I earn enough to cover the 100 or the 125% requirement. So that does not concern me. Appearently you're thinking my fiancee wrote that response, AND YOU'RE WRONG!

And why do you want to get personal with quotes like "Well we all don't have a Sugar Daddy" and "I seen the Pic". Why would you attack someone like that without even knowing who they are or what you're talking about??? Do you not like the picture I picked out for this website? And what is a sugar daddy in your eyes? Is it problem for you....the pic?

I can't believe that anyone would have the audacity to make such statements when they (you) obviously don't know the context of the conversation. As a matter of fact, this was your first post to this thread...so how could you get an attitude about someone you don't even know making a simple statement. Maybe you should apologize...what do you think??

Oh, Ms. Mav...I have been reviewing many of the other comments "advice" you have been giving around VJ...and now it's perfectly clear to me why you would attack someone that you don't know based simply on the premise that you disagree with their comments. Saw many times just now that you do this..you Even told one VJer "BS" as if they were lying. Did not realize you were the perfect all knowing Visa expert. Good luck to you Ma'am.

Thanks...JimVaPhuong, and that surely makes sense. I just have never seen that spelled out in the USEM Manila documentation. That's why I said I was not sure of the requirement for that embassy which is where my fiancee will have her interview...fortunately, I'm able to meet either standard so that's not a concern for us. Thanks for the clarification.

The OP's Fiancee is a Philippine Citizen and if you look at JimVaPhuong's content from the past and I agree: The Embassy will look at the Requirements of the Philipphine Goverment even though the Interview is held in another Country. Tax Returns for 2010 and Currant Income of the Petitioner. 125%. Not 100%.

Sorry if I Offended you from reading your first response to this Topic. We all have Stress during this process. We try and answer the OP's question as best as we can though I'm sure you can see Not Everything from Members is Solid Gold.
