Would this cause a delay in background checks?

My fiance and I have been waiting over eight months for our K-1 petition to be approved. We have been told since April (over two months ago) that we are undergoing background checks still. I have no idea what could be taking so long as neither my fiance or I have a criminal past of any kind.

I know that sometimes delays can come up if a false hit is found in the FBI name check database. If a person (latino) has two last names, do they search by the whole name (first and both last) or just first and one last? I can't imagine that a search of the full name would pull many hits, but maybe just first and last would because it is more common

My fiance had his passport stolen while traveling in France about five years ago. He immediately reported it to the US consulate in Paris so they could re-issue his tourist visa (which he needed to travel back through his connection in the states and home to Mexico). It was reissued with no problem although his tourist visa (which is valid until 2015) shows being issued in Paris. Would this bring up a hit on the name check database and cause a delay? Something they may have to manually pull? Or is this not related at all?

We were issued an RFE in April, too. Would they issue this if the security check was still pending? Does that mean once the sixty days expire from the date of RFE response they can still deny us an answer? Our RFE was for a passport photo of myself, even though I sent the two requested in originally.

I Strongly suggest getting your Congressman getting Involed at this point if you have'nt already tried.

WHY. Typical USCIS Service Requests Require 6 months and 1 Day with No RFE. This does not apply to your Case. Your stated a RFE in April. They have 60 days to Reply.

Your Congreesman will ask you to sign a Consent letter to act in your behalf so they can talk to USCIS. (This can be done On-Line)

Other than that, I don't know what to say except the squecky wheel gets the grease.

Time for attention to be brought to your case. 8 months is to long.

April 22nd your Response was recieved. Count the 60 days for a Reply. My RFE was recieved 5/31 so I count the 60 days.

I think you will get a response in a short time.

There is alot of confusion about this Topic and many Members never recieved a RFE. While in the waiting period USCIS within 60 days can REQUIRE that the Petitioner go in for a Personal Interview and asked to Submit Fingerprints at their expense. (This involves more time a well)

Darnell noted: There is a diffrence between the two. As Dumb/Dumber stated: Above, this is why "sometimes" they require fingerprints. Fingerprints don't lie to the identity of the person.

For clarification: I know what a RFE is. Did I say I was perfect.

There are two couples approved this week from August and September. The one from August did not show a RFE at all. I did get something from their posts though that may be a reason why some of us are taking so long. They were transferred from Texas to California and I believe ours was too. Took them a total of 10 months. Crazy.

All K-1 petitions are sent to California or Vermont from the Texas intake center.

The wait time for the OP is crazy though.
