Hi guys,

Few weeks ago I started sending out CV's just to test the field and I got a job offer but unfortunately I'm still on my K-1 visa and the wedding date is set for 26th of June. My question is can I somehow get the EAD faster? Can the employer do something? As I said I'm getting married on the 26th and if I file for AOS and EAD right after that date when is the earliest I can start working? I would really appriciate your input on this matter.

EAD takes about 60 dayas after it is filed to arrive. At this point there is nothing you can do as an EAD based on the K1 will expire by the time it arrives and until you are married you can't file AOS and an EAD based on the AOS. Unless you want to do a quicky court wedding prior to the church one and file now.

This will not be over quickly. You will not enjoy this.

As stated by the other poster you'll need to wait for the EAD. You CAN try and expedite the EAD but there are requirements for that. Do a search here on VJ for "expedite EAD" and they should mention the requirements. Unfortunately for you "I have a job offer" isn't grounds for expedite. The K1 has certain restrictions which they make well known and one of those is the inability to work. By all means try an expedite but at the very least you can't do anything until you actually APPLY for AOS and the EAD and then you'll need to try an expedite but it will still take around a month even if it IS expedite (you need to do biometrics which can take a while to come, then the expedite might take a week or two to approve and then to be mailed to you).

You need to send your marriage certificate with AOS, that'll take maybe 2 weeks to get. Then assuming you're able to file your AOS/EAD/AP right away you've filed mid-july. Get the expedite approved (which I doubt but maybe) you're looking at mid August to get your EAD. If the EAD expedite isn't approved it''s currently 2 months to get the EAD so you'll get your EAD mid to late September.

This is exactly why it's best you don't look for jobs. It's disappointing when you can't apply for/get the job of your dreams. Sorry but you won't be getting your EAD any time soon.
