Hi,

I'm about to send my AOS package(I-130,I-485,I-765,G-325A and I-864) and have a question stuck on my head about the biographic information on the

G-325A.

I came to the USA on a B-2 Tourist visa in Dec 2007 and since Aug 2008 worked and paid taxes with my ITIN number,which I do know,that does NOT authorize me

to work here legally.I did not know then,since friends told me that I could work if I applied for one.

On May 2009 I met my wonderful husband and we started dating,got engaged on Jan 2011 and had our wedding at the beach on April 2011.

Anyways I thought since I've overstayed and worked without authorization I could not adjust my status in the U.S but my husband suggested making

an appointment with Catholic Charities here in Pensacola,FL.We went to the appointment and the lady was very helpful and said that I still qualify

for AOS since I'm married to a U.S Citizen,she also told us to do not mention my previous unauthorized employment on the form G-325A.

But I'm very concerned about not mentioning it,because I feel that I would be lying and I'm pretty sure the USICS will find out such information.

Please is there anyone who has passed through the same situation?what should I do?not put my employment info or put it on the form?

Yup, that would be lying, which is why I am surprised a Catholic Charity suggested you do so

Honestly, since you worked and paid taxes, they already know you were working. Might as well own up to it on the G325A and save yourself the trouble of a misrepresentation charge

Yes, put your employment on the form, make your petition easy to approve

Yep I was surprised too whenever she advised me to "omit" the employment from the forms,I even said "wouldn't this be lying then?"

and she said that they weren't concerned about my employment or taxes,and would be easier to just don't put anything on it and say that

my occupation was homemaker on the I-485.

In my head I was still thinking that this would be lying,and decided that I would do my paperwork myself since they were charging $950 just to

file the paperwork that has pretty much most of the instructions on the USCIS website.

She also gave some misinformation about what to file with the affidavit of support,saying that only the original tax transcript ordered from the IRS

wouldn't be enough,that I also needed all w-2's and 1099 plus an employment letter from both of my husband's employers.Which I do know that is not necessary

since it clearly says on the instructions for the I-864 that if you have a transcript you don't need to send in the w-2's or 1099's and if you're above 125%

of the poverty line with your tax transcripts,that alone will be enough.

Anyways,so you think that even though I worked w/o authorization would be better to be truthful and put this info on the forms and would still be approved?

I can't believe they suggested that either...

In any event, list it. I'm fairly certain that both the overstay and illegal employment are overlooked when adjusting based upon marriage to a US citizen. 100% sure about the overstay being overlooked, 80% sure on the illegal work being overlooked. Either way, you don't want a misrepresentation.
