My friends is being forced to marry this guy she does not like from india. and i want to call the embassy or immigration and say something so that he wont get his visa. what do i say without hurting her fiance's chance of applying to another place in the future?

She can call and cancel everything with the USCIS. Why dont she just stop talking to him? That would be a good way to show him she is no longer interested in the relationship. Good Luck

it is arranged. she cant call and cancel she will get in trouble that is why i am trying to do this myself. i want to call and tell them not to give him the visa what should i say?

Oh my gosh! She's probably stuck in that. I don't know if it would be in her best interest to get out of it. It could make it very hard on her with her family. Maybe someone on here from India can give you more info on that arrangement.

Her family will look really really bad if she doesn't marry this guy. An indian friend called it off with the guy her parents wanted her to marry. she felt so humiliated and stopped hanging out with her regular indian friends cuz of the shame thats associated wtih breaking off an engagement but she refused to marry him thank God. Parents and everyone were calling her daily to try to force her to get back with him. about 6 mos later, she flew back to india, and her parents forced her to marry, but at least she was able to convince them to let her marry a good friend instead of one of the guys they had chosen for her to choose from. about your freind - if she is in love with another guy, then maybe she can elope with him here in US, then hide from her family for a couple of months maybe?

what she can do legally is send in a letter to ucsis, nvc, embassy, stating she no longer wants to marry him and to deny/kill the petition. but then her parents will find out eventually. if she does this then the guy won't end up with fraud or something bad on his record. i could only find this but i know i read about how to do this on an official website somewhere ..

http://www.ehow.com/how_5643039_cancel-k_1-visa.html fyi, visas can now be denied/cancelled even after the person arrives in the US - govt made this law so they could cancel visas of people they found out were terrorists after they arrived in US>

well thing is there is no other guy in her life shes just focused on her career right now and not marriage and wants to find a guy from the us not anyone from india especially this guy she hates him hes not good for her. and she's afraid to send a letter because she doesnt want her family to find out so she is basically running out of options. and thats why i came on here to see if anyone had more advice on this and i really want to help her without getting her in trouble.

Its never a good idea to preach for others on these serious matters. Also, the other side is, that you can be viewed as a over jealeous friend who can not see her getting married to a really wonderful guy. If she really does not like this guy then she can always cancel it herself, or via her family or via USCIS. USCIS or embassy won't consider any thing what you call or say what ever you believe.

Swtchik43, there is nothing really you should do for your friend - meaning you trying to stop the process. But if you still want to try, you can but you could end up in ugly situation (don't burn your hands).

Your friend need to make a decision on what she wants and can/ willing to do. She is legally the right person that can stop her process. All you can do is encourage her to be bold enough to take the right decision. It is better to be bold and face the current consequences, rather than face the ugly consequences tomorrow.

If the visa filed was K1, then even if he comes to US after getting visa, he can't stay beyond 6 months unless he is marries your friend. So it is better now then later that she needs to make a firm decision.

Your timeframe is not correct. When a K1 visa holder enters the US, they have 90 days to marry the petitioner.

so yer friend is the USCitizen, correct? She can write to withdraw the petition after it's filed.

Can submit the letter of withdrawal to

USCIS

NVC

Embassy

depending on where the casefile is.

That's the easiest solution.

What you're trying to do (submit some letter that YOU write) is termed 'third party correspondence' and may or may not have an adverse effect on either of them. It's just simpler for HER to write the withdrawal letter, herself.
