My boyfriend of 6 months has recently moved to the US for work. He has a work visa (H1B) and because of his status is able to apply for a green card immediately.

He wants to get married before he applies for his green card. ( just so we are clear, this is for love and nothing else).

Should we get married in the US or in our home country? From what I can see if we don't then I will spend the next 4 years or so apart from him. Can you confirm this is true?

Location of the Marriage does not matter, timing does.

The spouse of a H1 would get a H4 (Visa from Hell)

But would be able to adjust with Spouse to LPR and obtain work authorisation etc.

There is nothing immediate about US Immigration.

There is some misunderstanding - H1B is eligible for applying Green Card, does not mean he is going to get Green card in couple months. from H1 to Green Card it takes anywhere to 5 years or more.

There is nothing that is stopping him to apply for GC coz you are not married. Even if you get married now and he applies for GC you will only be able to enter us on H4 as boiler said.

Depending on what country your BF is from and under what EB cat he goes in will determin how long it will be before he can get a GC.
