expedite an immigration case!!!

Hi,

My parents got green cards in the states through me. Once my mom got her green card, she applied for my older brother to immigrate here and now he has to wait in line for several years until a visa number become available. my brother has epilepsy and my father has heart problems. Because there is no one to take care of my brother back home, my parents visit the US once a year for a month or less and they return to take care of him. My parents really want to stay here but they can't cos of my brother. I was reading about the expediting of an immigration case, can that be applied in my brother's case?

Wont work... You cant expedite in cases where a visa isnt available. You SHOULD have petitioned for the brother first if u could knowing the cercumstance... Or Petition only one parent and the other will watch the kid.

Your parents are risking their own immigration status by spending most of their time outside the US.

The petition approval process can be expedited for humanitarian reasons. However, there is nothing that can be done to move up his priority date and make a visa number available any sooner. He has to wait in line like everyone else.

If you petitioned for your parents, and he's your older brother, then I presume he's over 21, and his current visa category is F2B. It might have been more practical for you to petition for your brother in the F4 category. About a year before his priority date became current you could have submitted the I-130's for your parents. Everyone could have immigrated at the same time.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
