Hi, new member here. I've encountered a problem here regarding about the length of filing a fiancee visa. I and my fiancee from USA filed a fiancee visa sometimes in year 2009, but there is a personal problem on my end, so we cancel that. We met year 2008 and after that he did not able to visit me again until this year. We asked again to the same agency before that we will file our fiancee visa again, but they wrote back that we can't file the fiancee visa, unless my american fiancee will visit me again. Is this true? My fiancee can't be able to visit me again for some reasons and this cause him to feel discourage on me proceeding our relationship. I hope there will be a way we could file our visa not necessarily he needs to visit me. We have 3 years relationship this year and our communication is daily with few emails, daily phones, and daily chat. Her sister also visited me this year and would be willing to co-sponsor with me and my 2 kids. I hope someone can help me here and give me exact information regarding this matter and would be so much happy if I can find a real answer here. Thanks a lot!

One of the fiancee visa requirements is that you must have met your fiancè within the last 2 years, so if you met last time in 2008 I guess you don't encount that requirement.

Maybe your fiancee can get an USCIS infopass and talk to an officer about your problems, that's all I can suggest...

I suggest he come visit u this year and once he does that then u guys can file because it has been three yrs since he last saw u......good luck!

The agency is correct. The law requires that you've had at least one face-to-face meeting within the past two years. USCIS will insist on proof that this meeting took place. Without it, they can't approve the petition. Your fiance is going to have to visit you again.

While it's great that his sister has offered to help sponsor you, you should also be aware that the US Embassy in Manila frequently will not accept joint sponsors for a K1 visa. They occasionally make exceptions if the sponsor has a very good reason for not having sufficient income, and has very good prospects for improved income in the future (a college student or recent graduate, for example). On the other hand, if the petitioner has a limited or fixed income (disability or retirement, for example) then there's little chance they'd accept a joint sponsor. Visit the Philippines regional forum on VJ to get an idea if your case is one of the exceptions where they might accept a joint sponsor. If it's not then you and your fiance might want to consider getting married on his next visit and applying for a spousal visa, since a joint sponsor is always permitted with a spousal visa.

If there's a problem with the co.sponsor and the last meeting within two years, you'd have to meet each other anyways before filing the i129f. And if Manila doesn't accept cosponsors and you need a cosponsor, wouldn't it be more secure to get married and file as a spouse instead?

While I type I see Jim finished up suggesting the same.
