OK, how many in the family. The Requirement for 2 is about $ 18,400.00. Also, if he is active military then only the 100% of the Poverty Line is needed. If your looking at Adjusted Gross Income you are worried about nothing. However, how many in the family are in the Petition?

The Adjustment of Status will require 125% though. But, thats later.

Get Your She_____! together. Your so close. LOL. I think You'll be fine. Wish I had the Link to show you Military Requirements. They are 100% of the Poverty Line and not 125% when you Non-Military. But, remember the AOS will require 125% I'm pretty sure but, I maybe Corrected. Good Luck!

:rofl: i know they are 100% but i had doubts about the tax return and which part they look at.

Do you have a copy of his military W-2? His total income for the year will be listed on it (if he was in the military all of last year).

Also, remember importance is based on current income. He could have made $1/yr last year and now be employed making $50,000/yr. When filling out form I-134 (for the interview) and form I-864 (for AOS) it asks for your response to "I derive an annual income of ______" and "My current individual annual income is _______" - which is not the same thing as income earned last year (unless you are self-employed).

BTW, yes, the income requirement on form I-864 (AOS) is 100% the poverty level for active military, just as it is for form I-134. Take a deep breath, you should be fine.

Yep AOS is still 100% of the poverty guide for active duty military.

Already AOSd myself and the I-864 poverty guide says 100% for active duty military right on it lol..

is it stated as earned income in the tax returns?im trying to find it and im failing epicly

LOL your question couldn't have come at a better time!

I just was working with that same question with my CPA (accountant's title in US). Anyway, he wanted to make sure it was the Gross not net income and it is not in the instructions, or if it is, I couldn't find it.

So I called NVC. They told me Gross income (before deductions). I also had to find out what to do if you are a business owner with a corporation or LLC. Who would write the Employer letter for me if I were the Employer and I am the Employee at the same time? Answer from NVC was:

1. CPA or lawyer (don't have) write sworn affidavit that I am the owner with other pertinent information.

2. Copy of my IRS receipt of EIN# for taxes.

3. Copy of my business license.

Anyway back to your question: It's the Gross income!
