Question to those who were interviewed already...

Hi, I will be interviewed on May 24, 2011 and the USCIS letter stated all the documents that needed to be brought. My question is:

1. Will they look for the document stated therein one by one...

2. My husband is divorced with 2 kids from his ex. The letter also asks for the birth certificate of any child born out of a previous marriage. Is this really important? or is this something that can be overlooked?

Bring everything listed in that letter, plus a full copy of your original application. They won't look at them one by one, but they can ask for any one of those documents and you are supposed to be able to provide it to them in the spot.

Yes, the BCs need to be provided. I would not "overlook" that, if I were you.

My husband is my petitioner, and his two kids from his ex-wife are both American citizens living with their mother, they are not going to be petitioned, so I thought this is only necessary for those whose step kids will be petitioned by the petitioning US citizen. Thanks anyway.

Also, they are asking for my husband's Birth Certificate. But he is a naturalized US citizen. Will the Certificate of Naturalization suffice? He doesn't have his Philippine birth certificate with him...

You need to bring everything that letter says.

yes, bring everything they list in the letter, plus copies of what you have filed in forms as well as any originals such as passport, birth certificates, bank statements, leases etc. that you had sent copies before.

Better have too much then something missing and you will receive an RFE at the interview, delaying a decision. They will mostlikely not look at every single piece of evidence, document you will bring, but you don't really know in advance what the IO would want to see...

Don't have any kids with my ex wife so can't advice you on that topic.

So get your arm muscles strong and fit, so you can carry that heavy binder with you on interview day

He doesn't have a birth certificate at all? I imagine that was necessary when he went through the naturalization process, where is it? They may not ask for it but I have heard of it being asked for in the past along with the naturalization papers, so you really need to bring EVERYTHING it says if you don't want your AOS delayed.

I would also bring yours and the sponsors Social Security Card, I know it is not on the list but they asked for it during our interview.

He has a baptismal certificate which also states his parents' name and birthdate and birthplace.

No, the birth certificate is not a requirement in the application for naturalization... It must have been assumed that these documents have already been recorded and established while he was still under an immigrant petition.

Thanks, so they are also asking for custody papers for children of spouse not living with us. What is this custody papers they are talking about? My husband and his ex agreed on a no-fault divorce and settled amicably in terms of their children's custody and financial support. My husband did not have to register through the child support agency but gives a monthly financial support to his ex wife for the children. In my husband's divorce document, it stated that the kids will be under their mother's custody and that financial support will be discussed by both parties in the absence of a court adjudication, so no case will be filed in this regard. So, will this divorce document suffice, for the purpose of expressing the custody and financial obligation of and to the children? Many thanks.
