Does anyone know what kind of documentation or permission from the father, if any, you need to have for children included in the K1 visa?

You would need a signed legal document that the children have permission to travel with mother to live in the USA.

You will need either; 1) a court order from a court in the children's country of residence allowing the children to immigrate to the US; or 2) a notarized letter from the father allowing the children to immigrate to the US. Check with the US Embassy/Consulate where the K1 will be processed to get the exact requirements for the notarized letter.

I wanted to join in this discussion as I too am in the process of bringing my K-1 fiancee along with her child to the US. What all the other members are saying is true, but what I would like to know is if the child will be following at a later date, Is the permission letter still needed at the time of the interview or can we get that at the time when the child is ready to come? The letter is solely for the need to travel as I believe, so if we do not have it at the time of the interview does anyone think they would deny my fiancee's visa?

I just went through the process with my fiance's child about a month ago. No permission letter is required for the Visa process, but it will be required for when you are ready to travel. Depending on where the father is living will determine the type of letter and what type of notorization that is required. Our situation, the father lives in the US and he was able to get a letter from the Colombian consulate in Miami. DAS has there own letter that the father can complete if he lives in Colombia. This will need Colombian notorization by an attorney.

Dan is right...you'll need no letter for the interview at the embassy. You only need a notarized letter/agreement from the father to present to DAS when leaving Colombia. Keep in mind...every time you leave Colombia with the children you'll need the document, as DAS keeps the one you present at the airport. It's the same document...just a new one you pick up at the notary where it was signed. We were told it can not be older then a week old. I'm not sure how this works when the document is prepared in the US...as Dan & Jenny had done. We'll know more when we take our first trip back to Colombia this summer. Good luck.

Thanks to you both Galenjr and Dan for the information. I was kind of worried that could have prevented the visa approval. We finally found out the child's father is in jail currently, so we now have to try and get him to sign the release and i'm not sure how that's going to go, but at least now we can still go to the interview at end of this month and hopefully things will work out well. Thank you
