I've had enough this process has just torn me apart inside and after not seeing my fiance for 8 months. We lived together for a year prior to this so the transition has gotten to be too much for us. Is it possible to go back to China and wait this process out? We have a solid cosponsor. I called the senate's office today and was told it would be a month before they would even make a call to the uscis.

I see you had a RFE 31 Jan have you not heard since then? I would not go back for a long time as it is August since you filed but by all means a visit is not going to hurt. You are now in your 7 months so I would be making some phone calls too. You are way past the 5 month period. And basically the petition part is done this end USA you are just waiting approval yes? the rest happens in Leona's country now. I wish you good luck and hope you hear something soon

Yes, many do.

Note K-1 is a tough nut for the Guangzhou consulate, they tend to deny them way more than CR-1, if you are thinking living over there while processing, why not marry first and then file the I-130 for spouse visa while you are living over there. The resulting visa gets green-card the moment they arrive, the consulate looks at people who are married as seriously committed vs just be engaged.

USCIS will no prevent you from visiting a foreign country......they just have to wait to immigrate here.

IF you have that option, then you have that option.

USCIS just needs a US address to which to mail important papers, like approvals or RFE notices. Obviously someone should be there to man the address and convey any info to you at your foreign location so you can act on them.

; I'm in the US being with my baby til we receive our NOA2 and I wait til they forward my case to Amsterdam before I fly back to the Netherlands. My fiance will fly over for our interview, and we will fly back to the US together :innocent:

I've contacted my congressman and senator to no avail. The senate's office told me it would be a month before they would even call the USCIS and even then it would take another month for the USCIS to take any action. If Guangzhou denies the visa I'll most likely just stay in China permanently. America isn't such an amazing place to be worth all this trouble.

If that-s how you feel, then go wait it out in China and see what happens. If they come through, then you have the option to go back to the States, if not, then so be it. In any case, it does seem like it has been longer than usual.

Why not marry her and have her apply for residency as your wife??

Wow, if you don't want to be in the US that bad, and you don't think it will be better fo ryou, etc. - then why bother in the first place? You've got quite an un-happy, un-American attitude there...
