Hello,

I'm looking for advice and I know that there is somebody out there who has been in my situation before. I guess I should start with a brief history. I'm from the United States and moved to Scotland last year to study for my Master's degree. While I was there I met my husband, who is a British citizen. After a year and a half of dating, I graduated and had to move back to the United States. We did the whole long distance thing and then he came out to visit me. While he was here he proposed and us being us, decided to go and elope. After we eloped, he had to go back to the UK and we are now starting our visa process. We have decided to forego the K3 visa and apply for the CR1 visa because we would rather get all of the legal stuff taken care of at once. The only thing that I am worried about is the I-864 Affidavit of Support. After moving back to the states I was hired for a position making $28,000 per year. Therefore, according to immigration laws, I am financially able to support my husband. The problem here is that I haven't been making this amount of money for longer than three months, so any tax returns that I submit will show my measly student wages, which were drastically lower than what I am making now. Because of this, should I find a cosponsor to ensure that my husband's visa is approved or should I just use my current income and request a letter from my employer to help explain my current position and income? I'm really at a loss right now and any assistance will be much appreciated!

By the time of interview, you should have sufficient evidence of current income, 6 months pay stubs, and a letter from employer stating your income level.

The embassy in London is much less strict about this, and if NVC has no problem, the Embassy wont either.

Also K-3 would not have happened anyway, and you would have slowed up the process by filing the I-129F for it. USCIS would hold up the I-130 to match it up to the I-129F, and then eventually sent BOTH together to NVC where NVC according to policy will cancel the I-129F and proceed on with CR-1 spouse case. K-3 served only one function, it was to allow a couple to reside in the USA and WAIT for I-130 approval, since I-130 is being approved with the K-3 petition, the reason for K-3 no longer exits, WAITING for I-130 approval.

Letter from your employer stating your salary will be good.

I just went through that w/ London - I earned foreign income until February 2011 and moved back to the US in February, where I took a job that meets the income requirements. Got a letter from employer (dated February 15 or something) and it worked for my fiance's interview in March..
