Hi all,

Here is my concern and question. I applied for my change of status through a lawyer. I received a notice for finger prints. I got that done. I just received another notice for an interview. I'm not sure if I should go to the interview or not because I left my husband for domestic abuse and now I have a restraining order against him. I filed a VAWA through a different lawyer. I'm just trying to find out if I should go to the interview and explain to the IO that my husband as abused me and that's why he can't be there...If I go the the interview, will they still give me a green card or will they cancel the application with my husband and wait for the VAWA to be approved? Thanks

My interview through marriage had initially been set for one month after my ex assaulted me. I went to the interview by myself with a letter from my attorney with reference to the VAWA filing - it was stamped and I asked for a copy of it to be given back to me. I left after that - I never saw the IO. The letter specifically requested that the I-485 (which was filed because of the marriage) be placed on hold until the I-360 VAWA application was adjudicated by Vermont. I suggest you get a similar letter from your current attorney to get this done. One good thing about them placing your I-485 on hold is that while it is still pending you can apply for employment authorization and work.

I never filed a new I-485 - the old one was adjudicated after my VAWA petition was approved, and my priority date was the same.

My interview through marriage had initially been set for one month after my ex assaulted me. I went to the interview by myself with a letter from my attorney with reference to the VAWA filing - it was stamped and I asked for a copy of it to be given back to me. I left after that - I never saw the IO. The letter specifically requested that the I-485 (which was filed because of the marriage) be placed on hold until the I-360 VAWA application was adjudicated by Vermont. I suggest you get a similar letter from your current attorney to get this done. One good thing about them placing your I-485 on hold is that while it is still pending you can apply for employment authorization and work.

Hello N400-2011, congratulations on becoming a citizen of the USA :dance: :dance: :dance:. I AM SO HAPPY FOR YOU!!! We are both from the same country (BIG UP!!!), the road has been a long and hard one, but victorious in the end. I just had my I360 approved last month, and I am in a similar situation as you were in. I did interview with my spouse back in 2009 and got I130 approval and was waiting for the I485 adjudication, then I was abused and filed I360. My attorney had them hold the adjudication of the I485 until vawa approval. Now it has been approved, I am not sure what will happen next. The attorney told me that at the infopass that he went last week, the IO told him that my file was transferred to the National Benefit Center, which is going to schedule me for another interview at the local office.

Is this true?, if so,

How long should I expect them to send me an interview date?

How did your's went after your I360 approval?

Thank you... My oath is scheduled for September 15.

They will schedule your interview soon after your approval for the I-360 (mine took a little prodding by my attorney... When she went to them, I received the appointment notice a week later with just two weeks notice). The AOS interview itself was very straightforward and only took about 15 minutes. They don't ask anything about your marriage. I was asked for my passport, birth certificate and the orders of protection that I had. And then we went through the yes/no questions on the form. My passport was also stamped at that time.

You do not have to file a new I-485... They will adjudicate that one!

Thank you... My oath is scheduled for September 15.

They will schedule your interview soon after your approval for the I-360 (mine took a little prodding by my attorney... When she went to them, I received the appointment notice a week later with just two weeks notice). The AOS interview itself was very straightforward and only took about 15 minutes. They don't ask anything about your marriage. I was asked for my passport, birth certificate and the orders of protection that I had. And then we went through the yes/no questions on the form. My passport was also stamped at that time.

You do not have to file a new I-485... They will adjudicate that one!

N400-2011, thank you for your prompt response. The attorney did tell me he is looking to have an inteview date from them by September 1. So, I am praying for the best. I'll keep you posted. Thank you.

Hi, I know this post is old but how long did it take for your vawa to be approved and dos u get your green card successfully via the filed i485?

Oops...didn't remember that I took the VAWA stuff out of my signature.

 

The I-360 took 14 months to be approved.  I did not have to refile the I-485.  I had my green card interview 6 months after that.

After your vawa was approved were you scheduled for a second interview? Was the i485 approved. I have the same issue currently, so I would like to know. Thanks

Oh just seen this. Thanks for sharing! I had already filed my I-485 prior to filing i360, good to know that I don't have to refile.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
