Sorry if this is a stupid question, but I've just had a baby and a bit sleep deprived at the moment. I'm an American citizen and my husband is Irish. We've already filed the I-130 and he had his interview. However we forgot the I-864 so doing that now. I haven't lived in the USA since I was 16 and therefore have no income over there or have filed any taxes. We were told we needed a sponsor which is going to be my father. My question is who fills out the I-864 and who fills out the I-864A?

If you're living with your father sharing the same residence, you fill I-864 and your father fills I-864A

You both file the I-864 (one each).

Another thing: unless you have been unemployed since age 16, you must file US taxes, even if you live abroad. You won't need to pay anything, but the IRS requires that US citizens file taxes on income earned, even if they live and work abroad. You will be asked to show proof you files when your husband hands in the I-864, so back file now, at least for the last three years.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

As well as the I-864 and I-864A you will also need to provide proof showing you intend to return to live permanently in the US in the near future i.e. apartment lease agreement, job offer etc.

Oct 22, 2010 packet 3 received via email

Nov 15, 2010 DS-230 part 1 faxed to US Embassy Seoul

Nov 15, 2010 Appointment for visa interview made on-line

Nov 16, 2010 Confirmation of appointment received via email

Dec 13, 2010 Interview date

Dec 15, 2010 CR-1 received via courier

Mar 29, 2011 POE Detroit Michigan

Feb 15, 2012 Change of address via telephone

Jan 10, 2013 I-751 packet mailed to Vermont Service CenterJan 15, 2013 NOA1

Jan 31, 2013 Biometrics appointment letter received

Feb 20, 2013 Biometric appointment date

June 14, 2013 RFE

June 24, 2013 Responded to RFE

July 24, 2013 Removal of conditions approved
