That's true. I did check that box and she did not tell me otherwise at the SSA office.

Wow you're lucky.. I checked that and they looked for my EAD which I couldnt give them 'coz I dont have it yet. So I ended up with a letter saying I'm not eligible for SSN.

Im in North Dakota. So it really depends on the state.

All states are SUPPOSED to give you a SSN until 2 weeks before your I-94 expires (then they won't issue it). Once you have less than 2 weeks left on the I-94 you need to wait for the EAD or GC.

No it really doesn't depend on your state. It depends on what visa you arrived on (your timeline says K1), and when your I-94 expired (you arrived 14 Oct 2010 so it expired Jan 12, 2011).

In your case you arrived on a K1 visa which is SSN eligible as long as you have more than 2 weeks left on the I-94. If you have less than 2 weeks left then you need to wait for the EAD or GC. So as your I-94 expired Jan 12, 2011, it means that you had to have applied for the SSN before Dec 29, 2010. Some offices won't issue them if it's too close to the date either.

It also depends on your local office that may or may not know their own rules. SSN's are federally controlled (as someone else stated) so it's a national rule, not a state rule. Just some SSA offices are dumb.

Hi all im currently just filing in my SS-5 form for my social security number but i am confused by question 5? What do i enter? I came to America on a K-1 visa so not sure what i should tick? can anyone help me out? The options are: us citizen, legal alien allowed to work, legal alien not allowed to work, other

Don't worry about it. When you apply at a Social Security office in person you do not need a Form SS-5. They will enter the info into the system based on the answers you provide to questions they ask and the evidence you provide.

I applied when it started snowing here. That was October 28. So I guess the peopled I talked to there are dumb. ugghh. oh well! :)
