hi, my bf and i have been together for 3 years now, we decided to get married last year. due to the fact he does not want to settle with me in my country he has to get me a fiancee visa so i can stay with him and his family.

he gave me a form to sign up, on the I-129F form it asks "list all children of your alien fiancee", i had a child 10 years ago but i gave it up for adoption because i was young and still in college. i regret having done it , and i never was in a relationship again until i met my current significant other. should i list that i had a child before? because i am afraid i will be "misrepresenting" facts. there will be a medical check up and i will tell the doctor that i indeed have had a child before. if the medical documents reach the interviewer, they might accuse me and ban me for life. i have nothing to hide but this was my past and i really dont know what the law might say about this, please help me.

thank you for your time and have a nice day.

Well I suppose the answer to that is easier thought of as if you were a surrogate parent. You gave birth to the child, but you didn't keep it. Another way would be to think about if (god forbid) the child had died. While you HAD a kid, you don't any more so the answer to the qn is no, you have no children.

You are correct though that you can tell the doctor that you had a child and gave it up for adoption but technically you don't HAVE a child. which is what that question is asking.

That's correct. You "have" no children. No worries.

hello thank u so much for the response, i have not been myself in a few days due to this issue. i would also like to ask that

fiancee or k1 visa asks for this other form (if im not mistaken) which is:

http://www.state.gov/documents/organization/82063.pdf

it also asks me for names, this is to be filled up at the hospital or clinic before my medical exam..

im just really worried that the doctor will write a remark on the medical result and the consul will read that and use it against me.

sorry if i sound paranoid, i tried for the first time to apply for a tourist visa back then in 2008 because my bf persuaded me, and the consul who interviewed me

was not nice ...

That's the DS-156K. YOU fill that out. The hospital or clinic don't fill that out at all.

On the medical forms if you LIKE you can take the adoption documents with you (though it shouldn't be needed) and again at the interview you can take the adoption docs but seriously, think about it as if the child has died. You HAD a child but you don't HAVE a child. You are NOT lying. You no longer have a child. There is no way USCIS would ask you to PROVE that your child has died (if that were the case). When the child was adopted the birth certificate was changed to list the adoptive parents as the parents of the child (different countries do this differently).

You do NOT have a child. There is nothing for you to worry about.

thank you so much for the response, i just wanted to clarify it because i did try to research about this matter online before posting here

yet i cannot find a similar situation.

As you move forward, bear in mind that unless a form asks a question in the past tense, the question is asked an should be answered in the present tense. "Have" is not equal to "ever given birth to" or "ever conceived".
