After a few months I am back with the outcome of my case! A few of you like JustBob,Milimelo Myansha etc were so helpful back then that I feel I need to share the conclusion of that part of my Journey. Here is a link of my case to refresh your memories and understand what I am talking about LOL

http://www.visajourney.com/forums/topic/257475-case-out-of-the-ordinary/

Outcome

My last update on the previous link was that I've had received the "Extension letter", well after almost 5 months from the date I got it, I received the Biometrics letter for Nov 5, 2010. I took my fingerprints then the waiting game began once again. I was sure pretty sure that because of my case being so : out of the ordinary" I was going to be called for an interview but they didn't and in January 13th I received an email stating that my "Removing of condition was approved and my card was ordered" I felt so happy an relieved, then 10 days later I got my new GC.

Now I have a question, I don't know if some of you remember that when I made the infopass and the IO told me that the case was "closed" and I had to fill a new I-751, He proceed to tell me that once my I751 was approved and had my new card I could apply for citizenship any time. I am ready to send my N400 on March 7th but now an inmigration "lawyer" who is a friend of a relative told me that I had to wait at least 3 more years after I got my Permanent Residence.

However, my new card date says Resident since xx/xx/1999. Can I apply or not?

Thank you for reading my case any input would be nice!

Thank you! I do believe that I can apply too but because of the trouble I had removing the conditions I am a little bit apprehensive.

I can't figure out why your lawyer would say that. You can file yesterday. And be assured, the N-400 process is a walk in the park, not like anything you had to go through so far.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

Hello Again,

I am filling my N400 Application today and I have a few questions:

1) Do I have to file under the 5 years rule?

2) The question were it says permanent residence date since? Do I write the date it says on the card? ( Resident since XX/XX/1999) I am asking this because of the two's I751 I had to file that got me pretty confused about applying or not, dates etc.

I think you DO have to file under the 5 years rule unless you want to apply as a married spouse of US citizen or you are or used to be in the US military

You've been a PR for long enough to choose which option you want - 3 or 5 years. You could even tick both and then explain the ordeal to the IO if he/she is interested to hear.

Good luck on the final step in the process - I truly hope it's a smooth ride with naturalization! :star:
