Which taxe form or schedule?

My husband and I have everything ready except im a little nervous about the tax sheet is it the 1099 and all schedules or 1040 and all schedules? All i have is 1040s of most recent tax return as well as the past three years......someone pls advise i plan on putting it in the mail tomorrow thanks?

You need ALL the papers 1040s and 1099s everything.

It would be much easier to just call the IRS and get the Transcripts mailed for the years you need, then you don't have to worry about having all the pages and the W2s etc.

1099 is a wage statement issued from your employer at the end of each year for "independent contracting work." Most normal jobs are on the payroll as employees and would get a W2 instead. 1099 is NOT a tax form that you fill out. Not everyone gets 1099s.

That is exactly my thought. When I was an employee, all I dealt with was the 1040s, Now I'm a private contractor and only deal with 1099s

Who has been asked?

For all of this affidavit of support stuff, a complete tax return is required, as you know. What constitutes complete is different for every person. Some people have 1099s, W2s, schedule C, schedule A, whatever. The 1040 is the tax return that everyone fills out, so that is the one thing everyone should have. So if someone was paid via 1099 and did not send in a copy of that wage statement, they could get an RFE for it, but I for instance, didn't have 1099s so they can't ask me for them.

1099s are sort of like W2s. It is a wage statement (proof of wages), issued by the employer at the end of each year, just like a W2. It differs in the fact that a person who is paid by 1099s is not on the payroll at a company (not technically an employee, but rather a "independent contractor" who provides a service), and the employer therefore, doesn't have to offer benefits of any sort or deduct any taxes for them. It's like a responsibility dodge for an employer To be fair, there are probably good reasons for this in some circumstances, I just don't know of them personally.

So, it's difficult when people (especially new immigrants here) are looking for what to send in with their tax returns, and just hear a bunch of numbers, and moreover, not every US Citizen does their own taxes or understands what is going on with them. People say often "send in your W2s." Well yes, most people probably have to send proof of wages, but it can be either a W2 or a 1099 (and probably more types), and not everyone has one or the other. Usually people just have one type depending on their job. The only people that would have both, I think, are people that worked more than one job in a year and therefore were paid in two different ways by two different employers, or someone who got hired as a temp (1099) and then later got on they payroll (W2).

Regarding schedules and other forms, some people itemize their deductions and therefore have to fill out a schedule (I think it's schedule A or C) and attach it to their tax return. Some people take a student credit and fill out form 8898 (or something) and attach it to their tax return as proof. If someone does this, then they need to send all of these extra forms in when filing the I-864. But not everyone has these things (and probably most don't).

So anyway, if anyone has been asked for these things in an RFE, it is because USCIS knows that they were paid via 1099 or that they filled out schedule X and did not submit it with their I-864.

Because not everybody gets A W2. I have no income on a W2. I am not employed. My income is shown on about 6-8 Form 1099s. They have to cover all types of people so they say include your tax return and W2s/1099s to show some proof of how you got the money on the tax return. I could crank out a fake income tax return on TurboTax saying I made $200,000, but USCIS wants to see the official source of that income to back up the tax return. A transcript from the IRS doesn't need that back-up because those W2s and 1099s are reported to the IRS too. If they give you a transcript, it means they are basically saying the return has been accepted and the income has been proven to them.
