My fiance has her interview in Phnom Penh on August 25, 2011. Im hoping our evidence of relationship is adequate. We dont have chat logs from on-line communication but we do have receipts from Western Union showing monthly financial assistance. Does anyone have advice or recent experiences to share regarding interviews in Phnom Penh? Should I fly from the States to be there or should my fiance go alone?

Don't rely heavily on those Western Union receipts. The consulate understands that a US citizen petitioner is going to give some financial assistance to their fiancee in a poor country, but proof of payments does not constitute proof of a relationship, and there are circumstances where proof of payments can backfire. I recommend you don't offer those receipts to the CO unless they specifically ask for them, and focus on getting some evidence that proves you communicate regularly.

It is always a good idea for the US citizen petitioner to be present on the day of the interview, even if they can't go inside the consulate.

If the petitioner is not allowed in the consulate, or is not allowed inside the interview room, the beneficiary can show the consular officer the petitioner's passport in order to let the consular officer know that the petitioner is present and is there to support the beneficiary. I believe this can help win an approval.

How was your case resolved? My fiance failed her interview on October 19, 2011 and the whole package is being sent back to the USCIS here in the states. The CO claimed we had not known each other long enough (3 years!) and objected to seeing Western Union receipts. My fiance was also a little nervous. They claimed our relationship to be a SHAM. I dont know at this point if we can refile after the application expires or if we will be banned. Any thoughts?

The problem is over there at the Embassy.

As a former embassy employee I will tell you that this is NOT the best attitude to have. It is not their problem, it is your challenge. You have a higher bar to meet than those from countries like the UK or France. Past fraud and other international issues make it easy for some and hard for others. You are on the heels of those before you, and if the Embassy receives word that they have a high rate of fraudulent applicants, it is the liars and cheats who have made things hard for you. Meet their standards with respect for them and pride in yourselves. Show them you are not one of those who ruin it for everyone else. Leave them with a feeling that they know they did right by you and maybe the next honest person won't have it so hard.

03-23-2011 - NOA1 received in mail, dated 03-09-2011.

05-31-2011 - RFE requested. They want better passport pictures of me.

06-06-2011 - Additional passport pics sent.

12-05-2011 - Delivery confirmation per USPS.

12-27-2011 - (3) NOA I-797C received, dated 12-20-2011. Biometrics appt set.

01-10-2012 - Biometrics.

01-20-2012 - Notified of interview appointment for 2-21-2012.

01-31-2012 - EAD and AP approved.

02-08-2012 - EAD/AP card received.

02-21-2012 - AOS interview approved. EAD/AP card confiscated.

03-01-2012 - Green Card in hand!!!

364 days total time!

it depends on the embassy whether petitioner being there matters or not. in laos, older female petitioner and younger male beneficiary will still go under AP (and 50/50 chance approval) even if the petitioner was there for the interview. seen this happened many times recently. while older male petitioner, with a younger female beneficiary, being there for the interview can go either way but will likely get approved whether petitioner is there or not. it really depends on the embassy and CO and everything else involved in your situation.

I am so sorry to hear this :( I am guessing that you've been living in Cambodia, and got to know your fiancee while living there? If so, three years of knowing each other is a long time... Drats, the Phnom Penh Consulate is difficult.

I agree with another poster here... Get married, and then file CR-1. All the best to you and your fiancee!

July 2010 -- Received NOA2 in 71 days from NOA1.

August 2010 -- Cancellation of K1 Visa application.

i think western union receipts alone will not prove a romantic bf/gf relationship for 3 years. it can also be interpreted as a girl only wants money from you. the CO has interpretation based on what might seems like.

my bf/fiance send me only 2 times and wired to my bank account. one for my wedding gown and the other for the medical and visa.

if the CO claimed that you haven't know each other for 3 years i will speculate that there is no evidence proving your 3 years of relationship.

example of showing 3 years of relationships can be: (these are what im collecting for my interview)

>love letters with dates from 2008 to present.

>greeting cards

>random yahoo messenger conversations dated since 2008

>emails

>pictures together when u visit her in cambodia

>screenshots of facebook or other social media showing you two has communcation and relationship since then

>your phone bill statements showing her phone number (highlight them) this will show that you call her every now and then if not everyday.

>alot more, just think of things you both share together that has dates and shows relationship between the two of you. i mean relationship as lovers.

i can speculate also that there are questions from the CO asking her about you and she might not know the answer which might show that she does not know you that much. which of course gonna doubt the 3 years relationship.

i believe communication is the key to a genuine relationship. prove that you two communicate. gather those documents and get to know each other more. when she has all the needed documents and know you from head to toe and your life, she will be confident enough to face the CO and i don't think the CO can still say you guys have a SHAM relationship.
