AOS preparation....HELP PLEASE!!!

Hi everyone!!

The time has come and im preparing my I485/I130 ETC..Im the beneficiary and im adjusting from a b2 visa thats been expired for a few years now, my husband and I will be married for 2 years this april. Im pretty much done filling out the forms,however, im kind of at a lost because these directions the forms provide can be so confusing so i have a few questions as far as the evidence/documents that i need to include with the forms...

I have a list of all the things i will include..please let me know if i'm missing anything...

1. copy of my passport

2. copy of i94

3. arrest record (will this affect the outcome i had 2 cases both were dismissed, also do i need to include an explanation of what happened or just save that for the interview)

4. copy of my birth certificate

5. copy of my visa

6. i693

7. i864

8. g325a 1 for me and 1 for my husband

9. husband's birth certificate

10. marriage certificte

11. child's birth certificate

12. car insurance with both of our names

13. 7 passport photos of me

14. 1 passport photo of my husband

15. filing fees...cant forget that lol

Please let me know if anything is incorrect or if i need to add anything.

Do i really need affidaivits, pictures because we really havent taken a lot of pictures over the course of our relationship and when we did one of us were behind the camera...hmmmmm...cant think of anymore questions right now mind is going blank so if theres sometnhing you feel i should have asked you're welcome to answer that too...Thanks in advance...so nervous!!

Treat each form separately, as each application - I-485, I-130, I-765 etc has it's own checklist. That means you can't mix up everything as you did above. You need to come back here with a better presentation. Per example:

I-485

........................include all the docs required

Once you are done, go to the next step:

I-130 - include everything requested, even though you might have to include stuff that you already included under I-485

You don;t include in your package "7 passport photos" all together, they need to be split as requiered by each form.

Also, you need a certified translation of your birth certificate, as I don't see it on your list presented above.

I hope that helps, however start again and follow the checklist for each form.

Thank you so much for replying, i will definitely do that...so do i need to put each form and its supporting documents in a separate envolope and then put them in one big envelope??

My birth certificate is already in english..that should be good right

sounds good to me....and I am sure you already knew that you have to create little sets of the papers for the different papers, divide up the passport photos and add the right copies.....

Just add a few lines for a cover letter with you and your spouses names, explain who's the USC and who's the benificiary and thank them for their time (though it is there job) and you're good to go.

01/04/2011 - Oh boy....Received Interview Letter today - February 3rd is the day! :)

02/03/2011 - Interview scheduled 12:45 p.m. - out of there before 1:30 p.m. - further review

Coming home, checking for touches at 5:30 p.m. - CARD PRODUCTION ORDERED !!!!

02/09/2011 - Yup another e-mail saying that my card production was ordered.

02/10/2011 - E-mail notification "Approval letter was sent today"

02/14/2011 - Welcome Letter / Approval NOA and Card (separate envelope) received!!! :D

Late November 2012 (have to look up my receipts ;) - mailed in ROC I-751

12/12/2012 - NOA 1, status extension received

12/18/2012 - Biometrics appointment letter received

01/08/2013 - Biometrics done

Here is the VJ Guide. I-131 is optional if you don't want to use it. If you have overstayed, you can't use it anyway. From your list, I see missing stuff for the I-864, like a complete tax return and a current letter from an employer. Just separate out each form, as Juliava suggested, and work on them one by one. You will have to disclose your arrests and bring original (or certified) court documents to the interview (I would also send a photocopy with the application). Good luck.

I have another question tho, do i have to file the form I131 for AP, i dont quite understand that form...i dont think i would use it bcuz i would rather wait and just travel on my GC...do i still have to send in that form and if so what do i say about travelling plans because i have none and if i did i would wait on my GC anyways

You don't have to send that form if you are not looking to travel. However if you have en emergency you won't be able to leave

US until your GC arrives. Hopefully that won;t be your case.

so im going over my documents and i realize that my name MELLISSA is spelled MELISSA on my marriage certificate...is that going to be a big issue do i need to get it fixed or will they overlook that??

Yes, and also the same for your husband, even though you are using a co-sponsor.

Regarding name misspelling, I would get an amended certificate at your courthouse... don't want that to be a problem throughout your life.

I agree with you, if there's no major reason, a medical emergency in the family there's no real need to file for AP I-131. I didn't file for it neither myself as my parents have been flying to the US to be with us on our wedding day last May, will have enough time to go and see them once I receive the greencard.

So yes, unless you already know that you have to leave the country, file for it, if not, then don't, as you there's no plans and reason as you said.

The only "disadvantage" is to my knowledge, that once there is an emergency where you would have to leave the country to get back home you may have to pay for a filing fee if filed after all. If sent in with the AOS package it's included in the price.
