My friend is a PR and she wants to leave the US for 7 months to handle some family issues in her home country. How long does USCIS allow and PR to lease the country without the absence affecting their status as a PR.

Couldn't find any concrete answers to the question, so I posted it here.

Thanks in advance for your responses.

She can be out of US for months but NOT more than a year. I went home to the Philippines and stayed for 6 months and never had a problem coming back here in US.

I had my AOS interview recently, and one of the things the adjudicating officer advised me was that if we were planning to travel overseas, and we would be away for less than 6 months, there would be no problems.

He also advised us that if we thought we would be away for more than 6 months, that we should see them at the ASC and they will help us with paperwork we might need to help us re-enter the US and avoid problems at the POE...being away for more than 6 months becomes an issue and can be interpreted as abandonment of permanent resident status, even if you already have the green card.

I suggest she go to the nearest USCIS local office and speak to someone there for assistance before she makes her travel plans final.

That's what they usually tell u not to be out of US for 6 months but as long as u won't be gone for more than a year u shud be fine coz ur Green card will be ur passport to re-enter US.

CBP is allowed to look for evidence that the immigrant abandoned their residency after six months absent. They are required to assume that the immigrant abandoned their residency after one year if they didn't first obtain a reentry permit.

Can lease the country for 14 years, no PR status required.

However - most ppl will say 6 months and prior - no worries.

a '7 month family issue' almost sounds like 'have a baby' instead.

What's up?
