I have seen on some posts that if one files an I-765 together with the I-485, the $1010 fee for the 485 will cover the 765 as well. In other words, no need to pay the separate $380 filing fee for the 765. Looking at the instructions for the 765 however, I am not so sure. Here's what the i-765 instructions say on page 8:

"NOTE: If you filed Form I-485, Application to Register Permanent Residence or Adjust Status, as of July 30, 2007, no fee is required to also file a request for employment authorization on Form-I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of Form I-485 as of July 30, 2007."

I read this to say if you filed the 485 by July 30, 2007, you don't have to pay a separate fee for the I-765. But it doesn't say anything about people filing after that date, meaning the separate fee should be paid for filings (I-485) after 7/30/07. Did I miss something in the form or instructions?

You are missing this:

"You may file the I-765 concurrently with your I-485"

and it says "as of July 2007" which is when the new fee-waive rule was made, not if you filed before then. If you file this after July 2007, you do not have to pay the fee. I know the wording is pretty bad. Maybe it should say "starting July 2007."

You don't have to pay the fee, really ;)

Edit: The fee for the I-485 packet is $1070 now, and I believe there is further confirmation in the I-485 instructions if you don't believe me :)

We filed in 2008 and paid $1070 for both i-765 and 1-485. We just filed for removal of conditions. That law took effect in 2007. Good luck.

Thanks Harpa and Bayojona. I just checked the I-485 instructions and sure enough, it says "Effective July 30, 2007, if you file FOrm I-485, no additional fee is required to also file an application for employment authroization..."

Thats definitely better wording than the I-765 instructions.

Before July 2007 you paid sepeate fees for I-485, I-765 and I-131, after that date, the fee paid for I-485 also covered I-765 and I-131 when based on pending I-485.

Fee is $1070 for all.

I-765 needs (C )(9 ) for question 16 (Based on pending I-485)
