WRONG

Who Can Get a V Visa?

Spouses (husbands and wives) and unmarried children under the age of 21 of lawful permanent residents may apply for V visas under these conditions:

* Lawful Permanent Resident (LPR) petitioner MUST have filed the I-130 immigrant visa petition on or before December 21, 2000;

* Priority date is at least three years old;

* Priority date is not current;

* Applicant has not already had an immigrant visa interview or been scheduled for an interview;

* Petition is not already at an embassy or consulate abroad; and

* Applicant is otherwise eligible as an immigrant

The priority date is the date the US Citizenship and Immigration Services (USCIS) received the petition.

I am really confused when I check the waiting list data against your predictions. Here is my interpretation of what going on, please correct me If I am wrong. It only applies to 2A category:

Total waiting list for F2A category is 361,038 (as of Nov '10). Mexico has 45.3% of the waiting list. So outside Mexico total waiting list size is: 361,038 X 54.7% = 197,487 or Lets just say 200,000.

Now per-country limit of a particular visa type is 7% so out of 88,000 F2A visas something around 8,000 will go to Mexico. The rest 80,000 visa will be divided among 200,000 people in the waiting list.

So to do that it will take 200,000/80,000 = 2.5 years So there should be a max 2.5 yrs waiting time for people outside Mexico for F2A visa category. And that's the case If I am conservative. I haven't taken into account the people that become naturalized citizen during that time and their spouses move to immediate relative of USA and taken out of the queue, or the children that become over 21 and then transferred into the F2B queue, or if their parents become USC and then they are in F1 Category. Even if it happens to the 30% of the people the waiting time should become less than 2 yrs.

What do you guys think?

I am agree with you, let me add my math here,

Gross total all other chargeabilty is 119,294( Except Mexico, Dominican rep, Haiti, Philipines and Cuba)

5 top countries 7% of 88,800= 6216X5=31080

Rest of country(88800-31080)= 57750

For Chargeabilty country Visa waiting 57750/119294=2.1 years

May be possible for Chargeabilty country would be move forward to 3-6 months on February Visa bulletin.

Please correct me if I am wrong..

Your calculations are right. Does that mean someone who filed in nov 2010 will get visa in 2.5 years. :) I am still :unsure:

Theoretically you are right but the whole system is made in such a way that to complete the entire process will take 4- 5 years or LPR gets close to nat dates.

Last 20 years approx time for complete process takes about 4.5 years for LPR status. Some how DOS math doesn't meet our expectation. Anyway, even we count new visa waiting and upgrader list..still be the same assumption...wait time around 4.5 years for F2A.:bonk:

Allow me to ask...

I took about 20 min and read over the " Annual report Immigrant visa eff nov. 1, 2010. Not 100% clear but honestly felt good while reading it. My priority date is January 3, 2010 around when do u think the case maybe "current" for jamaica... In the F2A? Per the report jamaica wasnt sitting high on the top 5 countries. The total visa for the FY 2011 is 88,000 and asumming any other visas not used. what is the per country limit?

Thanks

I am agreeing with you ricardo, i remember in 2006 when my husband got his greencard his priority date was ahead of what the bulletin stated. I think the countries with the higher waiting list will be affected more by the retrogrssion.

Folks I think we are all missing something, It takes on average 3months(or less) to get case complete at NVC. Up to July of this year USCIS was holding petitions for families of permanent residents and approving them only when the Priority date was near. suddenly withing one month the processing times for spouses of LPRS jumped from the middle of 2009 to 5months(at the VSC) same time frame as for spouses of US Citizens at the same time the visa bulletin publushed by NVC continued to progress at a rapid rate. Therefore, assuming that all those applications sitting waiting to be approved were approved and forwarded to NVC why didnt we see the retrogression from say september or even october. If all these approved cases were sitting at the NVC so we could have data presented to us as at November the 1st with such a huge waiting list why did the progession of priority dates continue. It would appear that all these cases were sent to NVC within one month.

Well lucky for you, ur case is already completed so once thngs start moving again you won't have such a long wait. I am still waiting for approval from USCIS hopefully they won't decide to hold my case until the priority date is becoming current again. Its still better than it was before earlier last year the PD were 5yrs behind nw they r 3yrs. Lets try to stay hopeful.
