Not enough information to respond. What is the household size? What is the income? Is it from employment or self employed? Is the $52k income or the 401k balance. Have you read the I-864 instructions and reviewed the form itself?

32,145 from work (not self emplyed) and child support ( easily proven by consistent paymetns and paperwork) I live with my three daughters and appying for my husband so there will be 5 of us......I lack just $92 dollars to meet the 32237 income requiremtnst for 125% but I also have a 401k which is right now currently

100k as profit

weve read everything

juts concerned

Ok, you'll show income as income and assets as assets and they'll decide on their own how to value your 401k. You DO not calculate the value of converting the assets to income and add them yourself to the actual income. Remember they consider "liquid assets" to be something that can reasonably be liquidated within a year without undue harm to the sponsor or their family. I don't know what you mean by 100k as profit but if you mean there is $100,000 in the 401k account, in your own name, they won't count that as the full amount. They know there are tax penalties for withdrawal that will reduce the value significantly. They would also reasonably conclude that liquidating such an account may well cause undue harm to the family.

I would secure a joint sponsor if you can. What are the ages of the children. If you have three teenagers, they know the child support is short term. Remember, they consider the totality of the circumstances, whether you want them to or not.

we are filing our i 864 and as of right now we have a total of 5 in our family and this includes my foreign spouse the total annual gross income is 32145 so as of today we lack just $100 dollars from 125% but we do have 100k in a 401k that could be liquidated if we had to. I should have an evaluation in May and will prob get a raise and be fine but until then will we be ok and approved as is?
