Hello,

We're in the process of applying for a K-1 visa and have discovered we will probably need a waiver for my fiancee's previous overstay. In our research we came across a lawyer online named Laurel Scott who operates the site visacentral.net. We're asking whether anybody has had experience with them and can recommend them or another lawyer. This is an important decision for us and we are concerned about wasting time and money by working with the wrong lawyer.

Any direction you could provide will be most helpful.

Hi, I am no expert, but your fiance described her situation the other day, and to my understanding of her situation she really did not appear to have an overstay. Before spending big bucks on an attorney for what may be no issue at all you could try this site:

You can chat will immigration attorneys there and find out if this is truly an issue which will cause a need for hiring an attorney.

From your fiances story, I gathered she lost her job after 911, and stayed in the US for about a year after that, but returned home well before her work visa expired.

Hi,

Now I'm confused, from the other post and some information on visacentral.net, it seems I'm in the 'overstay' category somehow :( for example the post below....

If you were terminated from your employer, you have 60 days to find a new employer that will sponsor you. If you do not find an employer that will sponsor you in that time, you have a grace period to leave the US. Each day that you exceed that grace period is time out-of-status. If you exceed more than 180 days of time out-of-status, you have a 3 year ban on entering the US... If more than 1 year, it's a 10-year ban.

If the ban is still valid, you will require an I-601 waiver to overcome it.

So I'll check that site you suggested too, thanks for another source....

Namwan, don't worry before you have to. Ask for advice from the lawyers and get more information. We're all pulling for you!

Well, sorry if I confused you. I am absolutely no expert, which was how I started off my post.

I would say you should at the very least consult with an attorney either at visacentral or the site I suggested to see if your fiance even got tagged as an overstay.

I hope not! But the others who posted the terms of H-1B cause me to believe you may have a situation where there was an overstay, I am sorry. Sure hope not!

I had a phone consultation with Laura Scott and, subsequently, exchanged a bit of email. Her fee was $75. The phone consultation was very helpful -- and the fact that she subsequently put her comments in writing in an email will be helpful when I discuss matters with my fiance.

Scott of course would be willing to take my case -- but she is also giving me advice that would remove complications and eliminate the need to hire an attorney -- if only I can prevail upon my fiance to accept the advice ! :)

For the first K1, we used Holmes & Lolly. They were fine, and I wouldn't use them again. But an attorney who shows you how you *don't* need her services looks a bit like a gem in the rough!

Laurel Scott has an excellent reputation in regard to handling waivers. Chances are good that one half hour phone consultation with her will answer all your questions and put you in the right direction. I would highly recommend this as opposed to email or a chat - you need direct, personal attention and need your specific questions answered regarding your situation. A half hour with Laurel for $75 will be money well spent - I did it and she explained everything very clearly. She will not push you to hire her - in fact, she may not even be taking any new cases. But she will clarify everything.

If you do need a waiver, you do not need to use a lawyer. Once someone experienced and knowledgable answers your questions and clarifies any confusion, you can handle it yourself and save a ton of money. You'll find great example waiver letters and assistance on immigrate2us.net.
