When can I file for a K1 during annulment

My soon to be wife (I hope) Has filed for a anullment in the philippines. She is expected to get her decision any day now. Once the decision is granted. Can I then file for her K1 Visa or do I have to wait for the finality before I can file or do I have to wait till her papers are processed through the NSO? And if so how long does it take to have her prior marriage erased from the NSO? Please we have been going through this for 2 years now. PLEASE PLEASE HELP

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The prior marriage will not be erased, her CEMAR (Certificate of Marriage) will be amended to reflect that the marriage was annulled.

Technically she isn't free to marry until the Finality has been issued and recorded with NSO. I don't know how long it will take, sorry.

Can't file for K1 until you have the certificate of finality AND the old marriage certificate annotated and scanned into the NSO database. How soon you can get that done largely depends on how competent your lawyers are (they are supposed to help get the documentation ready for NSO processing after the annulment is final).

As Bob said, her previous marriage is not erased; it will remain on record, however, the annotated marriage certificate will reflect that it is annulled.

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

How long does an annulment process usually take?

The entire process could take less than a year or, if you're unfortunate, years. There are so many factors that could delay the proceedings. You and your lawyer must be vigilant in making sure that the proceedings go smoothly.

u can file a k1 after she get her Finality, enclose to the k1 packet her CD and Finality. U dont have to wait for the annotated MC, the process of registering the annulment in the NSO is 2 wks.

And if so how long does it take to have her prior marriage erased from the NSO? Please we have been going through this for 2 years now. PLEASE PLEASE HELP

June 19, 2017: Case is in Line for an Interview
June 25, 2018: USCIS Scheduled an Interview
Aug. 02, 2018: Interview Date- APPROVED!

We went thru this in March of 2010. The annulment was granted March 2010, and the NSO had the finality recorded with documents available August 2010. Patients is key to success with annulments along with the financial means.
