I am an Indian citizen planning to get married to American citizen in month of May 2011. He is coming to India on jan 1 and going back to WA,USA on May 22. Our marriage will be registered with the Registrar of Marriages through Special Marriages Act in March (or April at the latest).

I would like to know what will be the best course of action and the speediest for us to go about securing spouse Visa for me. Can he apply at the US Consulate in India for I-130 or does it have to be done in US. How long will it take for I-130 and I-129F to be approved if he files the petition? How long do I have to wait in India before I can fly to US. I have a multiple entry Tourist Visa valid currently. I have been to US once before on the visa. Will this help in my application for spouse visa?

Kindly advise!

Forget K3 because it's dead. The CR1 is the spouse visa currently available to you. Have your US Citizen (and you too) click on the word "Guides" at the top of any page here. Study the CR1 visa guide carefully and then return to the CR1/IR1 forum with your remaining questions.

Forget K3 because it's dead. The CR1 is the spouse visa currently available to you. Have your US Citizen (and you too) click on the word "Guides" at the top of any page here. Study the CR1 visa guide carefully and then return to the CR1/IR1 forum with your remaining questions.

You will have to file I-130 (USA) along with copy of marriage license. USCIS will notify you 5 mos after they completed the investigation.

The above is not accurate. Perhaps there's a language problem. USCIS sends notifications promptly. It takes about five months currently to get a filed petition approved but that's a small part of the story. Click on "Guides".

Thank you for the help. I have read and re-read the CR1/IR1 guides thoroughly. I have also begun making a rough checklist. This is a very helpful site and forums!

Are you saying K3 is no longer an option?

Yes, and hasn't been since February 1, 2010. Follow the CR1 guide. K3 is dead.
