Hello All

I filed the K-1 visa 5months again, it hasn't been touched in 4months. Does anyone have any experience with filing a K-1 visa with the California Service Center and how long it takes to get the NOA2?

Thanks

TSC, CSC service centers are back logged it means they have to

many cases and not enough people to process them. SO many K-1 and

CR-1 and other visa are on hold not being processed yet.

There is a 180 days time frame for them to get them processed,

If you havent been approved by 180 from the date of your notice NOA-1

than you should contact your service center being your in Ca.

It's luguna Nigiel, Ca. and ask why your case isnt arrpoved yet until than

you have to wait until they catch up doing the cases or which ever is first

they finished or exceed 180 days from your NOA-1.

Good Luck

check the law

USCIS has 180 days by law and they dont have to approve you until than if they dont want

For the record, there trying to meet the 5 month approval but they dont mean they have

to do it. And if your case is NOT they will tell you wait until after youR NOA-1 180 DAYS

CALL AN ASK THEM AND THEY WILL SAY IT 180 DAYS. THEY DONT HAVE TO APPROVE YOU BEFORE

150 DAYS IF THEY DONT WANT TO. ITS THERE LAW THEY MADE IT NOT ME. THEY CAN FOLLOW ANY

RULES THEY WANT TO APPROVE YOU AT 5 OR 8 MONTH IF THEY WANT.

AND 11 MONTHS IS THE TOTAL PROCESSING TIME AND NOT JUST 1 PART OF IT.

umm where is this actual law?it does seems like its a law made by you.

USCIS national goal is five months,CSC is currently processing withing the national goal, and the uscis national average is 20.08 months.

get your facts straight,its 150,not 180

Good Luck

in any case don't they update the website to the last application processed if its going to be beyond 5 months? in other words, if they aren't meeting their goal they will say the last case they processed. i think you can count on being within five months if you don't see them changing that goal. even if its 4.9 months =)

good luck!

I am struggling here a little. Is it 150 or 180 and is it a goal or a law? Are there 150 or 180 days of processing or just dust collecting? What is 11 months? And what USCIS average is 20.08 months? If it really takes that long, I think I would rather just sellout a move to Venezuela. Are all of these numbers and statements about goals and laws just venting driven by a very frustrating process operated by seemingly incompetent government employees?

And while I am on a roll here, the whole USCIS thing is scary. Lost paper work, conflicting answers, astounding ignorance and punitive processes all from USCIS. How is it possible that an RFE can be generated asking for documents that are already in the possession of USCIS? How do I know that the documents I sent to USCIS will be in the folder that an adjudication officer looks at? How do I know that someone is not going to have a bad day and just drop my entire package into the circular file. How do I know that USCIS ever sent me anything. If a piece of paper is lost, why does it cost so much to replace it? Why should I have to just hope and pray that the person who looks at my file is having a good day, is competent, has everything I submitted and will not get distracted or just plain check the wrong box.

In case you are wondering what "venting driven by a very frustrating process" looks like, just read again.

the goal is within 5 months, meaning they try their best, however that doesnt guarantee anything, and it can take anywhere from 5 months to 20.8 months

20.8 is a fact, meaning at this point, the slowest petition's petitioner is waiting 20.8 months, however they are trying to reduce it to five months, which is the average for CSC and VSC.

these numbers are taken from USCIS's check my case status page.

I feel you on the venting part! Unfortunately, we have to maintain hope and wish for the best. We're all on that same boat (or have been)! As for the timeleines, unfortunately, I can't tell you. I know that personally, when I look at the USCIS website I've seen the word "goal." I know of people on this site that have not been within the 5 month time frame and have subsequently been approved. It's just a matter of when they get to it. Five months or not. I think the rule is that you just shouldn't start making inquiries until after the 5 months have lapsed. Happy filing and good luck!

they suggest 180,because if your five months are up,and you call em to make an inquiry, they will tell you to call back within thirty days.they are summing it all up

You can obtain help from your state senator or state congressman for your district after a 5 month period. Not a day sooner. When they get involved, you will get action from the USCIS. My wifes NOA2 was received within 2 days of asking my state senator for help.

Go to your state senators or state congressmans website. It has a VISA help section.
