good day. need some help with my case.

had my interview at manila last nov.2010 for H4 visa as dependent of my husband but got denied coz i wasnt able to tell that i lived with my husband 5 yrs before our marriage. this is a requirement if your marriage was solemnized by family code art. 34.

below is the family code, art. 34 of the Philippine constitution:

Art. 34. No license shall be necessary for the marriage of a man and a woman who have lived together as husband and wife for at least five years and without any legal impediment to marry each other. The contracting parties shall state the foregoing facts in an affidavit before any person authorized by law to administer oaths. The solemnizing officer shall also state under oath that he ascertained the qualifications of the contracting parties and found no legal impediment to the marriage. (76a)

pls let me tell the story of our lovelife so you could find the right way to help me out.

yr 1999 when we started our relationship,

yr 2000 after graduation i started to live with him in the apartment with his family.

yr 2002 i went to saudi with 2 yrs contract and

yr 2003 he followed me and we worked in the same hospital. (note: unmarried couple are not allowed to live in one house in Saudi).

yr 2005 we went back together to the Philippines and applied again to different agencies.

July 2006 i flew back to Saudi

oct 2006 he followed me again, not the same company but near to each other.

nov 2009 we went vacation and got married under art.34

aug 2010 he went to USA holding H1B visa

nov 2010 i had my interview at manila but got denied.

the consul asked when did we live together? i answered just Nov 2009 which contradicts with art. 34.

i thought he was asking about official date thats why i replied like that.

im planning to get an appointment for interview here in SAudi. i just got an affidavit of explanation and the art. 34 oath that we signed during our marriage in manila city hall authenticated by DFA. i also gathered all our pictures and letters i haven't tried to show off to the consul.

would it all be enough as a proof of our togetherness? what else do i need to prepare?

H4 is one of the simplest visa's to get.

Sounds like all you need to do is provide the Marriage Certificate.
