Hi...you dont need to make 50k for sponsoring your wife. You actually need around 18k to 20k. Even if you are not able to make this figure then dont worry u can take any one as a co-sponsor. I think you need to read the following thread in detail,so you will get the idea about your future process of how to bring your spouse to US. Please spend some time on it and read it. Good luck

Hi guys, my income was in the $20,000's last year when I filed tax return. Someone said I need 2 years of tax return showing I am making more then $20,000 a year. So, I only had that much income for one year but if I go overseas to live for a 2 years now, how will that effect the process of bringing wife from India? Mind you the $20,000 income only happened once so I still need to file for another year but if I am overseas I can't file for another year. Thanks for your help.

You should be fine, my income was about 20,000 as well for last year of work and wasn't making any money the years before that. I was fine, they should accepted it as long as you let them know.

Read the guides first and a lot of your questions will be answered. If you go to live overseas for two years, and you no longer have income here, you will have to have a co-sponsor or else you need to come back, get a job, then sponsor her. If it is just you and her, and you have no children, then your income of $20,000 is sufficient, but if you have children, a higher income would be necessary.

I read the guide. I think the guide says I need 3yr of tax return but someone said 2 years. I only filed $20,000 income one year only until now. So, do I need one more year tax return? When I come back in 2 years, will I have to wait 2 years to file 2 different tax returns to call the wife? I don't own a house in US and don't have a co-sponsor which why I am trying to figure out how it will be done.

I am moving back to India due to sick parent and bad economy here. I will plan on returning in few years since I am US Citizen and have lifelong visa I can come back. Thanks in Advance.

Look at the I-864 instructions, because it talks about how you maintain domicile in the U.S., if you are living out of the U.S. temporarily, etcetera.

You might look at this person's case too, as they would be coming from another country, having never lived here in the U.S., but as a U.S. Citizen sponsoring his wife: My link

Since you are a US citizen, you can stay in India without any problem. But you will need a co-sponsor (only a US Citizen or US Permanent Resident) that can sponsor your spouse (that person need to support his/ her dependents plus your spouse). Your I-864 will become less significant but will have be filed correctly - regarding 3 past years tax returns with your I-864, you can submit 2010 and explain why you don't have for the other two years (depednd on when you case gets to NVC after your I-130 is approved).

This link gives you the poverty levels for different number of family for 2011 (18387 for 2, 23162 for 3,...) - http://www.uscis.gov...form/i-864p.pdf. It will change around March 2012, so just google I-864P and you can the details.
